Horde King...my friend recently got a DWI and hasn't gone to court yet. Her lawyer, who is a friend of her mothers, told her to go to Tennesee asap to get a liscence so that when she loses her liscence in NJ she'll stil be able to drive...Aside from probably being illegal, don't you have to have residnece in another state for 6 months before you can get a liscence there? She wants to drive all the way down there, get a liscence and come right back.......Can this be done?

a friend of mine was in a similar situation a few years ago. he lost his ny state licence, and went down to florida to get a license down there (his parents had a house there so it was easy for him to have proof of residency). but he still had to be careful driving in ny, if he got pulled over again, he really wouldve been screwed.

I'll just remind you that I never practiced criminal law and that your sister should consult her lawyer.
However, you said that she hasn't gone to court yet. As such, her lincense in NJ is still valid and she can continue driving with it until she pleads or is found guilty in court.
I see nothing illegal about getting another state license (as long as questions are answered truthfully and residency requirements are met).
Apparantly it must be done with some frequency as your lawyer friend already had a procedure she recomends. Check with her regarding the requirements for licensing in Tennessee to make certain that the trip isn't for nothing.
Finally, even if convicted or pleading, the judge may allow her to drive to and from work or school only. It depends on a few factors including the specific judge you get.
