i just need help

My brother is currently incarcerated. He had sexual relations with a young girl, prior to his conviction. A baby was conceived and born. My brother was never put onto the birth certificate because the mother protested. Well during my brother's stay on Riker's Island he was injured, stabbed he almost died, when we thought he was going to die, he asked me to care and cherish his daughter as if it were my own. I did just that for a year and a half. And I love my niece with all my heart and soul. My niece's mother has problems with my family and has stopped my family from visiting his child. My brother is currently trying to put his name on the birth certificate so my family could have visitation rights. My niece's mother is contesting it. Which means a DNA test has to take place. And I'm scared what will happen if the test comes out and says my brother is not the father. I'm wondering whether or not I wasted all that time. I'm wondering whether or not i should still love that child with all my heart. Im wondering whether or not I should still love the child if she isn't related to me. Anyhelp would be greatly appreciated. Thank you.

PHIXION - This is very far removed from any type of law I practiced and I urge you to consult an attorney with greater experience in custody matters.

I have a few questions.

1. Was your brother incarcerated for statutory rape? Or was the sex with the underaged woman not related to his conviction?

2. Did the mother know that your brother was the father? Did she acknowledge his paternity in any way other than on the birth certificate (such as baptismal record, social security application, passport, etc)?

3. When you indicated that you took care of your neice was that by providing financial support? Did the mother accept this support? Did you have custody of your neice - not in the presence of the mother? Did you guys go out to see a movie or to the park or something like that?

4. Your niece's mother is contesting your brother's paternal rights. Has there every been any type of custody trial to date?

5. A DNA test will prove or disprove paternity with such certainty that any doubt is not worth mentioning. If your brother is the biological father, obviously he and by extension his family, especially you who have provided support for 1 /12 years has an increased claim. However, if the DNA test disproves paternity the first thing that must be addressed is an appeal of your brothers conviction based on new evidence. (unless he plead out or was charged with a different crime)

No one but you can tell the depth of your feelings for this little girl and if you love her because she is your brother's daughter, or if you love her b/c of who she is, and your connection (whatever it is) to her.

Again I urge you to consult a custody attorney.

Don't worry, I deal with teenage girls complaining about their boyfriend breaking up with them. Evil is far more ruthless when your a teenager. But A good oil change is important cause if your worrying about it, I'm guessing your pushing 3500 miles. You need it changed. I dont want you shutting down on the Southern State.
