View Full Version : Buying a New Car

If I buy a new car in Delaware, which has no sales tax, but said vehicle is registered and documented in New Jersey, would that affect the montly payments on the car?

I figure that if I buy a 20K vehicle and drive 90 mins to go get it, I could save myself a thousand bucks on taxes.

There's GOT to be a way Uncle Sam will get his fucking cash, or everyone would do this within 100 miles of Delaware. But I wish you luck anyway.

the payments are determined by the bank, loan shark, whomever you borrow from. your state of residence is irrelevant.

Uncle Sam has nothing to do with it. It's state sales tax.

The sales tax is determined by where you live, not where you buy the car. The dealer is going to charge you the sales tax of the town/city of your home address. Sorry.

You might have to pay tax for the decomposing bodies in the trunk

rec is right.

sales tax on cars is
collected by your
municipality and state.
other wise you could do just
what you said and
dealerships in NJ, for
example, would die out.

good try though.

If I buy a computer from Dell, I'm not charged Sales tax.

My father said that the tax is charged on me when I present the bill of sale for my tags, but I still don't believe that. I seek ANSWERS!

Someone give me a website, something, anything.

And maybe the reason people haven't bought cars in delaware is that maybe, just maybe, the general populace might not be aware that DE has no sales tax?

I mean, do YOU know the sales tax laws of any state beyond your own?

I mean, if I buy a PS2 in delaware, when I bring it into Jersey, am I suddenly charged the 12 bucks sales tax? No. So what's the difference between that and a car?

http://www.state.nj.us/treasury/taxation/ Click on Tax topics, then individual sales & use taxes
I mean, do YOU know the sales tax laws of any state beyond your own? Although it is a sad thing to admit, yes I do.
I mean, if I buy a PS2 in delaware, when I bring it into Jersey, am I suddenly charged the 12 bucks sales tax? No. So what's the difference between that and a car? Technically, a NJ tax auditor would tell you that you owe the State the difference between the tax you paid in DE and what you would have paid in NJ. (There is one on the way to your house right now;-)) The only real difference is the State's ability to enforce the rules; they really only go after big ticket items, eg. cars. Internet purchases are currently exempt from state sales taxes but probably not forever. Dennis Kozlowski, the dirtbag that ran Tyco, was first arrested for tax evasion - buying a couple of Monets at an auction house in NY and using a maildrop address in NH (no sales tax) while taking the paintings to his NY apartment.
I'm not defending this, only trying to give you the facts. I admire the impulse to try to beat the system; just be forewarned they usually win. The Clash covered a 1960's song, I Fought the Law and the Law Won - it's worth a download from KaZaa.

The simplest way to explain this is that a car is taxed at the address to which it is registered.

If you register the car in NY, you pay NY state sales tax. If you register it in Delaware, New Hampshire or other tax free states and you don't live there, it's fraud and you can be prosecuted criminally for it. Worse yet, the IRS may come after you and that's always a bad thing.

When you buy an item from mail order or the internet, if they do not maintain a corporate presence in your state they might not charge you sales tax. However, you're nonetheless supposed to report it.

Haven't you read through the NJ Drivers' manual?

It's in there that if you haven't paid the appropriate sales tax on your vehicle, you have to pay it when you register the car.

Go to Motor Vehicle Services here:

http://www.state.nj.us/mvs/

Worst case scenario, you can call them.

If it's on the title that it was a 'gift' you don't have to pay sales tax.

If it's on the title that you paid the sales tax, you don't have to pay sales tax.

It's that simple.
