I'm an assistant DA in one of the five boroughs. OK, I just heard the replay, and that call sounded like bullshit to me. I'm not sure exaclty what Billy did, but none of what he said is a class C felony, unless there was some actual insertion of some kind (aggravated sexual abuse in the second degree, which is a C felony). Plus, under NYS rules of evidence, "A person may not be convicted of any offense solely upon evidence of a confession or admission made by him without additional proof that the offense charged has been committed." So, Billy can't be prosecuted for his on-air confessions alone.

The guy said his name was Steve McBride... I did a bunch of general searches and can't find anything about him being associated with the DA's office...

So my take is it was a good fake!

That guy did a great job he sounded ligit except one thing if he was for real it would not have been an on air call in. Besides all BILLY HAS TO DO IS SAY THAT IT WAS A BIT AND IT NEVER HAPPENED OR THAT HE WAS ON THE WRONG MEDICATION AT THE TIME AND IT HAD A REACTION THAT MADE HIM DO IT.

If that was a fake, it was definitely a good one. It didn't sound like your typical 20/30s guy doing a goof, it definitley sounded like an older guy. He was calm and didn't fall over his words or anything, which led me to believe that if it's not real, it's a damn good acting job.

At any rate, Billy probably got a nice scare and maybe we won't hear about stupid shit he's done again.

It was fake b/c Billy didn't commit rape. Rape involves penetrating the vagina with the penis (to any degree). Anything else inserted in the vagina (such as a finger) is not rape.

Billy would be charged with "Aggravated sexual abuse in the 3rd degree" under section 130.66 of the NYS Penal Code.

Finally, the caller reported that rape was a class "C" felony. That was the final tip-off. In NY, rape in the first degree (130.35) is a class B felony. Rape in 2nd degree (130.30) is a class D felony. Rape in 3rd degree (130.25) is a class E felony.

NY does not have a class c classification for rape.

The guy was a good act, but just an act.
