O&A To Sirius? XM? - 2/3 - We're hearing rumblings that former PM drive team Opie and Anthony, that used to be heard on WJFK-FM (and a bunch of stations nationwide) until Infinity canned them for that "sex in a church" contest last summer, could maybe be heard once again - via NYC HQed Sirius satellite radio. Also, we hear that DC's XM might be involved in discussions with the disgraced duo.....

It's possible, but I'd much rather hear the boys on FM than satelite.

Infinity'd have to release them...which i dont think they will do cause O and A make too much money, plus Howard's not getting any younger..

I would assume the most realistic thing for Infinity to do, assuming that they are not planning on putting O&A back on the air, would be to keep O&A off the air and not competing with them. At the end of the contract, I would imagine O&A would go Clear Channel, which linked fairly strongly with XM.

Here's why lawyers get paid big bucks.
Does O&A's contract with Infinity cover satellite broadcasts or is it only a radio contract? IOW, how "exclusive" is the O&A contract?
It seems to me a sharp lawyer could argue the case.

O&A's contract covers broadcast that is not authorized by infinity, that includes satellite radio.
Lets put it this way, It is very very unlikely O&A will go to satellite radio any time soon.

Infinity might consider letting them out of their contract if they agree to only go to XM or Sirius. Infinity might think satelite radio isn't really competition and they could save money on the O&A contract.
This is just wishful thinking. Besides, this is assuming the executives at Infinity actually think things through.

O&A's contract covers broadcast that is not authorized by infinity, that includes satellite radio.
Satellite radio is not broadcasted like regular radio. People have to pay a fee in order to get it. Much like HBO is not considered broacast like the networks, which is why they can say "F*ck" and show man junk on "Oz".

It doesn't matter as far as I can figure out Infinity, if there is a premium or not, it's still a broadcast medium not associated(at least in XM's case) with Infinity.

Consider the economics... Infinity owes O&A big bucks, if they have no intent on having them back on the air, Infinity would love to get out of that contract. There's no way that they'd rather pay these guys to sit on their arses. It's kinda like an ex-husband that can't wait for his ex-wife to remarry! <P>

Think of it this way, Infinity can be offensive and put O&A on the air, or play defence and pay them to sit at home. Think of it this way, It's cheaper to keep O&A under contract and pay them then it is to let them go to clear channel, get syndicated again, and start to destroy Stern.
Infinity is looking at the potential losses of letting O&A work for clear channel, not the current losses of the contracts, which are already budgeted.
