If the nation escalates to "red alert," which is the highest in the color-coded readiness against terror, you will be assumed by authorities to be the enemy if you so much as venture outside your home, the state's anti-terror czar says.

It works just like a "state of emergency" during a natural disaster, except (as we have found recently) that the government can raise and lower the warning level at any time. As stated above, This equates to to Martial Law.

the problem, moe, is that the government can do this at any time. The ability to control the comings and goings of a nations citizens by making public life illegal is Martial Law, the same thing that we deplore in Dictatorships all over the world.
Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or <b>the right of the people peaceably to assemble</b>, and to petition the government for a redress of grievances.

Another question: is this a violation of the first amendment? If we are being kept in our homes, seen as the enemy if we are to step outside, is not that an infringement on our right peaceably to assemble? after all, what's more peaceable than to go about everyday life?

There is nothing wrong in protesting . But when you block traffic you endangering cilvilians you assholes. If the government feels I'd be safe to stay inside until the people who are doing these acts are removed more power to them . If I see a protester blocks my car and doesn't let me pass I will knock them out. They are not making anypoints by trying interfere with other Americans way of lifes. You see the same people who call for free speech are hypocrites because if you don't agree with them they f'ing destroy property throw rocks etc. I know its not everybody but those who do cause damage reflexs on all of them and these protests look stupid.

First off, FEMA has had this power for years. It has never exercised it. We're not going to be under martial law anytime soon.

Secondly, the constitution allows for "peaceful assembly" with due process (i.e. obtaining permits and working w/in the bounds of the law). Disruptive protests, are not afforded any constitutional protection. Disruption refers to violence AND to blocking access to emergency and other necessary vehicles.

I would think that the government's ultimate responsibilty is to ensure the rights of man; life, liberty, and pursuit of happiness. During this Code Red, all three would be at risk. To ensure ultimate safety, people would have to stay at home.

I'm not just talking about the obvious interpretation of "assembly." being sequestered into your house any time the government sees fit, being kept from going about your daily routine, is a violation of the first amendment. Assembly isn't just a protest. It's being out in public.

our government of elected officals by the populace would never stand for a martial law that would enfringe on the self evident truths we are blessed to have in these United States.
the idea of martial law is for the protection of citizens until such a time when it can be lifted as a serious threat is abated and peace established.
if God forbid our government finds out there is a lethal disease about to be unleashed by terrorists in NYC and thousands upon thosands could be killed...wouldn't it be nice to enact a martial law? keep everyone in, safe and sound, and look for the culprits.
sure, you are not free to go out into the streets, and sure you are not free to do what you want, but LIFE is one of our gifts here in the US...how can you have Liberty and the Pursuit of Happiness if you don't have LIFE? Martial law is a last resort that protects, not enfringes, our lives.
There is a time and place for it...a very extreme time and place...and thankfully, a time and place not yet seen and hopefully never will be seen at all.
