A Question About Banning Members [Archive]

If a person on the board pisses off a moderator or administrator in person or "real life", can this person be "legally" banned from the board?

Since it has nothing to do with board life I would think the answer is "no," but I am curious as to what the true answer to this riddle is.

They shouldn't ban you for personal things, but they might try.

I hope there's a vote on things like that, and a ban vote would lose for petty things like that.

But then again, people get away with so muchshit on this board I wonldn't be surprised at it.

No, we don't ban people for personal vendettas. The mods/admins send at least three warnings to someone who is breaking the rules. Third strike, we vote on it.

OK so then I pose a hypothetical. Let's say a certain board member who has been active since the beginning of the board was banned for reasons outside the board life (personal life). What should this person do?

Legally, they can not. According to Section VII, Paragraph V of the New York State Civil Code, "message board banishments may only occur as a result of actions arising from said message board."

This law was tested in January of '02 with the case of PERRYNOID vs. F.M. Jeff, RonFez.Net and FoundryMusic.com., where in the plantiff, PERRYNOID, was banned shortly after having thrown up in the Defendants bathrooms at a New Year Eve party.

The Defense argued that this wasn't the reason behind the banning, nor was it his poor showing in Big Ass Night Of Fight One, but rather because he was "being annoying to an almost intolerable degree."

The Court ruled that although the guidelines don't technically forbid such behavior, PERRYNOID's presence did violate the "spirit of the law" and as such upheld his banishment.

I think the Moderators do a great job of keeping their personal feeling out of board politics. Btw, has anyone seen Jennitalia around lately?

Get over it? Because in all seriousness, being here is a privilege, not a right. You'd like to think that there'd be some fairness in who does or doesn't get banned, but shit happens.

I would say under most circumstances moderators wouldn't be able to ban members for actions in their private lives. But I think Jeff will do whatever the fuck he wants to whoever and what's anyone going to say about it?

There is a FAQ. It is clear. If you have a problem with a decision made by the moderators, administrators, and owners, please contact us privately or make a choice not to post on the board at all.

Bannings are never done unilaterally. There is no such thing as a personal-vendetta-banning unless this hypothetical member pissed off a majority of moderators off the board.

When you say, "as long as it's in your personal life and/or off the board", then the member should not be banned.. Does this also include IMs or Emails?

I had a run-in with a Mod/Adm., for sending out an email to everyone for a favor, which was to send their friends/family the link to my ebay item (which was a used computer).

This Mod/Adm. ended up threatening me with banning me for sending this email to him/her. I found it immature and un-called for.

I replied to that person and told them what I thought, how I felt and agreed to NEVER sending them ANY type of email again... but that was a bit rude, the way they cursed and scolded me like I was a child.

I didn't appreciate it, especially since I am one of the members who keeps away from the drama and the fighting that goes on here.

But anyway, was that fair? Can they get away with that?
Do I need to re-read the FAQs?
Have they been updated?

If someone is unjustly banned, they should contact a mod/admin. Members have contacted me in the past, and I forwarded their reasoning for voting by the staff. Best case, we let you back. Worst case, you stay banned.

We will not discuss bannings with third parties. The actual banned member must be the one to talk to the mod.

I had a run-in with a Mod/Adm., for sending out an email to everyone for a favor, which was to send their friends/family the link to my ebay item (which was a used computer).
The use of RonFez.Net for personal gain by members without express prior permission by the RF.Net administration is strictly prohibited. To use RF.Net resources in any way for personal gain will warrant a warning at the very least.
