View Full Version : Car Accidents and Lawsuits
Ok, I got in an accident in February 2002 that was legally my fault (technically her's). Her car was destroyed and they took her away in an ambulance "as a precaution" but with no obvious injuries according to the police report. . Today I got a letter from her lawyer, but it's not a suit yet. This is all going to be on my former employer's insurance, as I was driving their van when this happened. I know they will handle it, but I am a bit nervous, having never been sued before. So I guess I was wondering if I am screwed.

I just sent back my rental. One month and my car is fixed, damn unisured drivers... F'ed me over big time. I was in an accident in Feb too that totaled my car... still havent gotten any money back from that, cause the insurance company is some place in the city thats run by part-time landscapers... I'll be lucky if I see anything from that.

You're not screwed, but you can expect to be named in the lawsuit as the driver of the vehicle.
Chances are great, that it will be settled out of court w/o any involvement from you.

Exactly. My dad is a personal injury lawyer and 99% of his cases are settled out of court and that includes major cases like paralysis and death. Just stay informed of what's going on and you should be fine. If you have any questions for me get in touch with me and I'll ask my dad.

damn unisured drivers... F'ed me over big time
their are terms in your policy that can be had to cover you if you get involved in an accident with and "uninsured" driver or "under-insured" driver... not sure if there is a "mandatory minimal amount" already in a basic insurance policy but you can increase the amount of coverage by paying a little extra...
we were in an accident with what was considered to be an "under-insured" driver... he had a basic policy which was 30k for personal injuries... it turns out the medical bills alone for us were near 70k... our insurance covered each of us for an additional 300k apiece... in essence we received a personal injury settlement from our own insurance company, even though the accident was his fault....

I was on a jury last year for a car accident case. The 3 people involved all took the stand and told their side of the story. They each had a different version and there was no real evidence except 2 or 3 photos of the street. One lawyer seemed like he was fresh out of law school-very inexperienced. And the other lawyer was a dick. He seemed to have more of an interest in making the young lawyer seem like a idiot (which he wasnt). It was a really hard case to follow because I didnt believe anyone was telling an honest story of what happened. They ended up settling out of court after about a week and a half.
