Look, I really hate to defend a guy who spit on a cop and beats his wife, but isn't this too harsh? I'd be all for taking a few more years on his sentence, but this seems ridiculous.

JOHN CARL Marquez, 36, was convicted of "placing bodily fluid upon a government employee," a felony that can carry a life sentence because of the possibility of transmitting a potentially deadly disease.

He probably would have gotten the death penalty had he done what Multiple Miggs did to Clarice Starling.

It's always safer an funner to throw feces anonomously at cops from afar. Sure they can test the DNA but you can always use the feces of someone else.
Another things cops hate is when you take shit and put it under the door handle of their car. Some cops don't even realize it and get feces all over the squad car, their radio, and their gun.



The funny(haha)thing is, they'll make room for him and let murderers/rapists run free

Right. This won't stand up on appeal. A great example about "Justice" gone wrong. I would also expect the state legislature to make some sort of move to limit the ability of court to interpret this law so broadly.

I agree that the sentence is a bit harsh in its proportion to the original offense, but the law itself sounds like a good one, and NY should adopt a similar statute. These days, spitting on anyone should be considered reckless endangerment since you dont know what the hell you have until after a subsequent blood test (if then). The penalty should correspond with the results of said blood test; deadly disease=assault 1, no disease=reckless endangerment. When this guy wins on appeal, his victory should be in the form of a reduced sentence, not a walk.
