My lawyer is a scumbag

Last August, I gave my lawyer a retainer of $2500 to represent me in my divorce proceeding (her normal retainer fee is $5000, but since my case was so easy and straight-forward, she only charged me half). She charges $275/hour, so I would be responsible for any charges above the $2500. Fine. I got my first bill in December. She charged me $275 to review and finalize the papers and took it out of the retainer. Fine. All that was left was the actual court date. After that, I should expect to get a final bill and any money owed to me.

My divorce was finalized on January 29 of this year. Come March, I call the office and the assistant tells me they do their billing quarterly. Ok, I can understand, since I got a "bill" at the end of December. April passes, as does May. In June I called and was told, "Oh, we didn't do billing last quarter, but I'll make sure she gets on it right away."

I find it hard to believe she is so lax in her billing policy (especially since it is painstakingly outlined in the lawyer-client contract that she expects prompt payment of all bills; not to mention the fact I was stuck in the courthouse watching her fur coat and Gucci briefcase while she made phone calls on her expensive cell phone!).

The second quarter has passed. What recource do I have to get my final bill and any money owed to me?

Send a letter in writing and ask her to give you a response by a set date. If she fails to respond to your satisfaction, send her another letter letting her know that you will be contacting the bar of your state. If you don't hear from her by then, contact the state bar.

Am I to understand that you are surprised that a lawyer is a scumbag?

One time my insurance company failed to pay one of my hospital bills because of some missing paperwork. Me and my mother forgot about it and it got lost in all of our other bills. It went through a collection agency and to a lawyer. The hospital would refuse to talk to us about the case because it went passed collection. So we contacted the lawyer, and they REFUSED to contact the hospital to get the missing paperwork so the insurance company could pay them. Instead, they pushed the case through small claims court, won the case, and demanded immediate payment. Only when we told them that we had no money did they finally get the paperwork for my insurance company. But we were still stuck paying for court costs.

The fucking bastards pushed the case through court so they could get paid court costs, rather than just get the information and not get paid. I hate lawyers.

Alice, I spoke to my wife (a lawyer) about this one and she suggests the following:

Call the office of the scumbag lawyer and tell them that unless payment of owed monies is made immediately, you will sue her in Small Claims Court and then notify the "Office of Court Administration" (the governing body that oversees lawyers and their actions). Apparently mentioning that Office is like sunlight to vampires.

As an attorney duly licensed to practice law in the sovereign states of NY and NJ, I suggest that you immediately contact your state bar association and lodge a formal complaint.

They will contact her directly and you'll certainly get a rapid response or they'll take measures against her including fines and proceedings to revoke her license (disbar her).

BTW, about $100 of annual license renewal fees goes to the NJ Lawyers Fund for Client's Protection to reimburse clients whose lawyers rip them off.

A 7 month delay in refunding money is grossly inapporpriate.

Small claims court is not the answer b/c even winning a default judgment there will not make it any easier for you to collect what's owed you. Contact the state bar.

I agree with Horde King completely, but I stand by my advice to write a letter to your attorney first. Threatening to contact the bar may be enough to get a quick resolution to your problem.
