Alright so next month I gotta go into court for custody. Today we were told Joint was out of the question because of things that happened in the past.

1) What is the REAL differnce between us having joint custody and her having full, if the terms of the agreement are all still the same?

2) niether of us is paying for an attorney and niether of us qualify for a court appointed one, so i have to figure out all the little things the count will want to know about.

Right now we figured out the visitation hours and the holiday schedual. Someone mentioned that it needs to be noted that i see school records and be informed if something happens with them in school. Also I know i need to have it say i am notified for any medical issues.


What else needs to be in this agreement?

Johnee, first thing is to get an attorney. Even if you cant afford one, you can probably work things out (they know they'll get their money in the end, so they will probably go with you even if you cant pay for them now). If you have one, you can get the lead step into this devorce.

Ok, first off, while in your case there may be no practical difference between sole and joint custody, since you and your former wife seem amenable to figuring out a visitation schedule, etc. - they are legally distinct, in that the custodial parent retains the right to make important decisions regarding the child's life (religion, education, medical care) without consulting you. While you may seek to guard against this thru a custodial or parenting agreement, you'll have a hard time covering every possible situation, and if you two disagree her wishes are gonna carry more weight.

Since neither you nor your wife wishes to hire an attorney, you might both consider custodial mediation through a family court mediator. It's relatively inexpensive, non-binding until you reach an agreement, hopefully non-confrontational, and since all the mediator does is deal with situations such as yours, he/she will be likely to point you both toward areas where you may run into problems in the future. Good luck either way.
