This is a bit of a boring topic...but I was wondering what peoples' experiences have been as far as getting back a security deposit from an apartment they rented.

I've been trying to get my deposit back from my last apartment for a couple of months now. I recently finally got some of it after much effort, and the rest that they didn't pay they said was for "damage to the floors". The floor probably got scratched up a bit (hardwood floors), but it wasn't terrible. They claim it cost $300 to fix it, the fixing being a new coat of laquer or whatever on top - does that sound right?

Any info people have would be useful.

My first apartment was in a new complex trying to draw in renters so I only had to put down a $100 security deposit.

I got $8.52 back a year later. SCORE!!!

That does not sound right. I mean, they will probably just make up some bullshit excuse that they hired a contractor to refinish it when in fact they bought a $20 can of the shit and rolled it on themselves.

Hard to prove in court. I think that a lot of these things are just up to the person you rented from, and you hope they're honest. I mean, you're not going to hire a lawyer to get a couple of hundred dollars back.

i've never had a problem getting my security deposit back, but i've heard this tale told many times before from friends. The mysterious damage is a common excuse.

We lost our deposit for the house my friends and i had in college. 2 of my roommates left without helping clean up, so we kinda left it on the messy side, and I understood why they kept it.

i'm on my 5th apartment now, and i've gotten my security back from every place, with the exception of the apartment i shared with my boyfriend. he got the refund back. i'm now living in an apartment owned by my aunt and uncle. my cunt of an aunt made me leave a security.

really depends on the landlord, and you should be able to figure it out before you move in. one thing is, you are entitled to the interest accumulated on your deposit. it doesn't necessarily mean you get it, ever, but there are laws regarding it. find a copy of the renters bill of rights.

i live in an apt in manhattan and i agree with you - rental security is a MAJOR problem. The mangemenet company who run these buildings have massive amounts of cash on hand, and lawyers on retainer. So if they try and screw their tenants out of security, and they get away with half with no argument thats a windfall for them! and if you do sue, they know you cant afford a lawyer as easily as they can.

I always try to use my security as my last months rent before i leave. They can sue ME, but id rather it go that way.

Before taking a apt, id consider the security deposit as a 'dealbreaker' item to consider. If its too high - take another apt. chances are you wont see it again.

I use to own a 3 fanily house in Pelham Bay, Bronx. Most of my former tenants were hard-working middle class folk. But I had 1 tenant who was the renter-from-hell. When he finally got evicted, it cost me 3 times the amount of the security to get his apartment back into shape...see, so it works both ways!!!

BTW...my good tenants got their security back(with interest) almost as soon as I inspected the apartment and I'm still friends with them!!

The best way to get your deposit back is to never pay the last month's rent.

Take thenm to small claims court. The tenant wins like 95% of the time.
