What are the odds that this leads to a wrongful death civil lawsuit by the man's estate against O&A and Infinity for causing the heart attack?

A third man involved in the sexcapade, radio producer Paul Mercurio, 43, pleaded guilty earlier in the day to disorderly conduct. The judge ordered him to perform seven days of community service with a group that delivers meals to AIDS patients.

Ouch. I would've taken 2 months in jail.

That isn't half and half in your stew.

God certainly works in mysterious ways.

The term "producer" is in fact applicable in the case of referring to Paul Mecurio's role on the O&A show in question.

There were times when he was involved as a guest, other times when he was involved in some part behind the scenes (i.e. suggestions regarding the program, writing humorous material to be used on-air, etc.). During the show in question, all "team" members could have been loosely referred to as "producers", although to someone who was acting in the capacity of a "team" leader, the term "producer" seems even more appropriate.

The complaint did not list all the sex stops the couple allegedly made, but police said after the arrest that they included a Disney store, the F.A.O. Schwarz toy store, the Carnegie Deli, an ATM vestibule, the back seat of a taxi and a hotel lobby.

If it were me, that's what I would want on my headstone.

I understand what you're saying, but I also remember when this was all going down and O&A even commenting that the description of his as producer was incorrect. They never saw him as such. I don't believe he was either. If anything he was a show writer or contributer, but not a producer.

That reminds me of the time some journalist referred to Stinky as a producer.

Mercurio admitted providing the live on-air commentary describing their actions and offered a mea culpa.

"Since the show, I realized how inappropriate these actions were. I have apologized personally to monsignors at St. Patrick's Cathedral and apologize publicly now for the disrespect we showed the church, its parishioners and the people of the City of New York," he said.

it's all fun and games until someone has a heart attack.

1 little radio bit has ruined so many peoples lives.

It's clear his heart attack was due to "stressing"
over this court case.
I say take the whole gang wnew gang to court.

I agree. He certainly didn't deserve to die over the poor judgement of a radio DJ and no over sight by management.

Poor guy. Spends 11 months in jail here in VA for violating his probation just by BEING in NY, gets out last month, dies. I met him when he dropped by Cancer Corner, he was a nice guy, not bitter at all. I'd be.
