my job justifies denying me overtime by saying i'm salary. yet each week i fill out a time card, saying i work 9-5. which is a bunch of bullshit; i don't leave until all the work is done. to off set this, i'll come into work and hour or 2 late cuz i know i'll be there atleast that much time later.
so is this legal? they do it to mostly everyone. there have been times where i'll work 60 hr weeks, and will take "comp time," which they don't allow either. they say you have to take "flex time," meaning if you work 10 hrs 1 day, you work 6 the next. but it isn't feasible sometimes.

Sounds like you're somehow both. I was salaried when I worked my federal jobs, but I still had a "time sheet" each week, where I noted how much time I actually worked, overtime included, not just 9-5.
I'm salaried running my bookstore, and I've only encountered "flex time" since working this job, but it only applies to the hourly employees who have to punch the timeclock. Each week when I do payroll I have to roll over their flex time and figure out who needs to go home early/come in late to pull in under 40.
So I guess to answer the question in this thread...I have no idea. Seems you straddle the line pretty equally.

Even though I'm in management I'm an hourly employee, my boss has this set up for me for several reasons, the most important being that I get overtime out of it. I hate jobs where you have to fill out a time sheet. We don't have that where I work, even for the salaried employees, there's something that gets entered into the payroll of salaried employees if you're forced to work extra days, but that's about it. The sucky part about being hourly is that I have to scan my badge when I get in (though I rarely do).

My guess is that your arrangement with them will remain confusing until you get one of "those" people working there and they make an issue of not being payed overtime, and then theyll be forced to change their book keeping and everyone will be payed hourly, which I think is fair for all involved. That " Im not able to leave till Im done" shit dont fly with homey. I worked for this company that had the most rediculous time keeping method, Id come in, sign a sheet, have to log onto our hand held scanners, and then log onto another sheet using the scanners time for every step of the way throughout the day so that basically, your every move was timed. The company Im at now, we have these high tech badges, that we use to get into the building, but once inside, we have to manually sign in on a sheet. Youd think that theyd put up a digital time clock or something, so as a result (which isnt always a bad thing) people saunter in 10, 15 minutes late and leave early and no one says anything.

when i got moved from Supervisor back into the union 'when the market shit the bed' my title was "overtime exempt".... although they were still giving me overtime for 18 months before they pulled it away. it's been two years and i haven't made a penny of OT and it is 'oochie ouchie smarts'
there are stipulations:
if i came in on my day off i would get it and i also get holiday pay if i work it but the 'network dept' has practically become expendable and we switch off on being 'on-call' When i was a Sup we had 5 people on 3rd Shift and 6 on 2nd's. Now there is no 3rd Shift and 3 of us on 2nd's.

It really all depends what your contract says, since it sets the agreement between you and you employer. I fill out a timesheet now for project management reasons, but I am overtime exempt. So if I work late, I don't get shit. I'm on flextime, but it's more of a come in between 7:30 and 10 and leave 9 hours later (8 + 1 for lunch).

I was getting overtime until recently. They did away with it for some people. My company has been screwing us over the last year, so now I'm just 9-5. I refuse to stay late, even though it's still expected of me.

When I used to be union (working in TV), We were only guaranteed 36 hrs a week, and had to fill out time sheets (2 per week) which the supervisor had to consolidate into a monthly form to send in to the home office. When I became supervisor, it got to be a major pain in the ass (which is one of the reasons I left that job).
My current position is salary. When I was hired, they sent me an offer with a set #. The thing is, I'm a contractor to one of our clients. When they sent me to Minolta, you had to sign in at the front desk, and the supervisor was a clock watcher. You would fill out your time sheet, and on Friday, he would check it against the front desk, and would sign off on it before it was sent to the home office. We would have 1/2 hour for lunch, and he made sure you didn't use any more than that. I don't like environments like that, plus the fact that it was a >2 hour daily commute for me pushed me to tell my boss to get me out of there - right quick.
At the Times, I've come in an hour late from time to time when there's heavy traffic or accidents and stuff, but they don't give me or my company any grief about it. As long as I'm doing my job, and making things run, they'll forgive being late here or there. In fact, I worked late for 2 days last week, about an hour each day, and figured that made up for some of the time I came in late.
