i remembered a discussion i had with a marine in atlanta a few years ago. pretty random right? so he was telling me in a potential fight situation if you tell someone:

"if you (do something that i don't want you to) then i will (cause you some sort of physical harm)".

is this legal? i mean if you tell a guy "if you come any closer i'm going to pop you," aren't you giving the guy fair warning that if he does this certain thing you will react in this manner?

i know the guy who throws the first punch started the fight, but if you're throwing the first puch b/c you would rather not get hit, is it still your fault?

No, it isn't that simple. I'm not a lawyer, so I won't profess to know all the legal ins and outs, but basically you have to have a reasonable expectation that you'll be harmed if you don't act for "self-defense" to apply.
The reason your statement by itself isn't enough is because it's not contextual. Taken to an extreme, if that were legal you could walk around to people and say things like "If you talk out loud, I'll hit you" or "If you don't give me your money, I'll hit you."
Now, if you're being threatened, or approached menacingly, those are potential self-defense scenarios.

here's the senerio: some guy is in your face saying "throw down;" now you make the if then statement to get the guy to back off and does what you tell him not to, ie. "if you touch me again...". are you legally at fault?

I happen to be an attorney(in Mexico). Never, ever use you're fists or warn someone if you're going to defend yourself...just shoot them and look for the nearest gypsy cab!!!

It doesn't matter what you say to the other guy. You don't have to give him fair warning - if you have a "reasonable belief" that the other guy is using or about to use physical force against you, you can defend yourself with physical force, as long as you weren't the initial aggressor. And you can only use it to the extent necessary to defend yourself - you can't kick the guy's ass and claim self defense (that's why Mike Tyson is in trouble again).

As far as just making the statement "back off or I'll hit you," if the other guy is challenging you to a fight, you haven't committed a crime.

No. It's not that clear cut. the events leading to the conflict are just as important as the conflict itself.

I was told in a Self-Defense class that the best thing to do if someone is threatening to start a fight with you is to put your hands up and say, "I don't want any trouble." This way, witnesses will see that you tried to disarm the situation. The last thing you want to do is throw the first punch.
