I'm very excited. I may be moving into another, nicer apartment. My question is: is it acceptable for me to tell my present landlord to use the month's security deposit as my last rent payment?
I'm a little concerned, because I totally see my landlord, who is also my aunt, minus the a, add the c, making a big deal about that.

That is exactly what I did when I left my last apt.
Granted it was 1986. I also gave up the interest on the deposit account to cover any damages or repairs. I think I was out about 50 bucks!

That's exactly right. The deposit is first AND last month's rent.

That is totally acceptable and legal. Most states have a tenants/renters association. NJ has an excellent one. Membership is $15/year. They are all the RIGHT answers to renter questions.

It's acceptable and some people will do it, but they don't have to by law. The deposit by law can be held until the landlord can do a walkthrough of the apartment (at the end of the lease) to assess any damages. My last landlord was a dick and I had to pay last months rent, and then 2 months later I got back half of the 2 month deposit I had left him (because I left my lease early (even though i wan't even UNDER a lease anymore) and he claimed he couldn't rent the apartment for a month).
I'm sure being that its your aunt she won't have a problem with it... it depends on the landlord.

You would think it wouldn't be a problem, being my landlord is my aunt (through marriage). But she's pretty much treated me as just any old tenant off the street. And I do see her making a big deal about it. There's too much family drama going on, which is a main reason why I'm getting out of there.

Jenn, the last place I was at, I called the landlord about getting separate security reimbursement checks for myself and my roommates. It was actually she who suggested using the security as the last month's rent. I'm fairly sure it's a commopn deal. And if it's family, it's a lot easier to broach the subject, I would assume.

I think the fact that I didn't sign a lease or anything is in my favor. And I was going to give her 30 days' notice. If I do take this apartment, and she does end up being her typical cunt self about it, I'll just move out sooner.

Well, I handled this the "mature" way. I tried to get my aunt/landlord over the weekend, but she was never around when I went upstairs. So I left her a note with the balance of what I owed her for last month's rent, explaining to her that I was leaving at the end of the month. If she and my uncle weren't so fucking self-absorbed assholes, I would've made more of an effort to be more courteous about my moving out notice. She hasn't said anything. But that's the beauty of my fucked up family.

That's what I did. But then again, I beat the shit out of my old apartment and had little chance of getting the whole deposit back.
