A man was charged with child abuse for not applying enough sunblock to his mentally disabled 12-year-old for a day at the beach, leaving the boy with severe burns, authorities said.
McKelvie told investigators he put sunblock on the boy, but the indictment said he failed "to apply enough sunscreen causing severe sunburn to R.M." while he had custody of him.
If convicted, McKelvie could face up to 18 months in prison.

Should this guy be charged with child abuse because he didn't apply enough sunblock to his child? I don't think so. I mean, I agree that if you're going to take your child to the beach or anywhere to be in the sun that you should apply the appropriate levels of sunblock. However is it something that if the person doesn't do enough that they'll go to jail for it?
If anything it's pure stupidity on the father's part.

You'd have to imagine there are at least hundreds of similar cases each year. Heck, we have probably all done it to ourselves at least once in our lifetime.
He shouldn't be charged with a crime.

Yes he should. We may have done it to ourselves at one time but this moron was responsible for looking out for the welfare of this child who, due to reduced mental capacity, was incapable of making his distress known. 7 hours. This guy didn't look at his kid turning red over that period? Was he paying attention to him at all? That is neglect. Hopefully the kid's mother is going to beat the living shit out of this guy once he gets home.

The man did apply some sunscreen, but not enough. Most people do not realize how burnt they are getting until they actually arrive home and look in the mirror or step in the shower.
And in many cases people feel that when it's hazy out they are not getting burned and it fools them because you can get really sunburned even on a hazy day.
Tough call...

My point exactly. This guy did put some on his kid, unfortunately not enough. Granted I would have did a little more research if it were my kid but he did make the effort to put sunblock on his child so I don't see where this would be something he should be jailed for. Again, I think he's stupid and should have done more, but on the surface of this case I don't think he intended to harm the child.

There's a long way between acceptable and a crime. Are we going to throw someone in jail for doing a shitty job in changing a baby's diaper and allowing the baby to get diaper rash?

You can't compare the two Hbox. Diaper rash is not on the level of severe burns. I don't think I'm being hyper-sensitive here. If your kid gets severe burns while in your care (and I don't mean by accidental scalding) over a 7 hour period - that is negligence in my book.

The bottom line, regardless of the child's mental state, is that they are the parent's responsibility. If the parents fail in protecting their children, it is their fault. That being said, I think the guy deserves community service or something.
By the way, that picture is NOT the kid. I would really have to see the kid's skin to decide on punishment for the father.

I don't know how a kid can get severe burns from the sun. When I was little I had been out a few times all day without any sunblock and yes, I got burned, but nothing I'd term severe burns. Certianly not huge blisters that would bleed. This just doesn't sound right to me.

For what its worth, I think it really does depend on the context of the situation. Until we an pass a law preventing stupid people from breeding, well stupid people are going to have kids. Even non-stupid people are going to make mistakes from time to time.
Was it just ignorance? Was it indifference? Who knows? I don't know what the best way to determine that is; I suppose by having children service coming in, checking things out, and maybe checking up a few times subsequent? That's really embarassing for someone who is a good parent who just made a mistake, however (hell, my parents are great and I remember an occassion when I got an awful sunburn in florida.. bad first degree burn, no scabbing... but it does happen; I still have scars on my back from a time when I got second degree sunburn on my back when I went fly fishing in Belize - 9 hours in the sun on a boat and all I had was the SPF 15 I'd put on before we set out - I forgot it on shore... all I had was a tube of chapstick that I attempted to smear on my face.. but no dice. Man that sucked, I wish I had pictures of it. I got bumped up to first class on the way home and I couldn't even enjoy it beause my ass and back hurt so much I could only barely manage to just perch myself on the edge of the seat) I guess a little embarassment is better than potentially overlooking a child in a danger, but I don't know. I'm sort of in favor of less government involvement, I guess.. hard to say.
I want to feel like if the guy was charged with child abuse that the police must have thought that there was sufficient neglect (a pattern of it? Or maybe he was an ass about it and insisted that he had done nothing wrong? Or was a real idiot and they thought this was the only way to get him a wakeup call?) to charge him with it, but you never know.
I recall the case of that woman with her kids, initially the polie we all yeah they had second degree burns it was bad bad bad, but as it turned out the hospital didn't even want to see them and said they just had first degree burns. I mean, it can happen to anyone. Yeah it's stupid, but it's a mistake, and shit happens.
And I agree with Funkman that often you never know that you have a burn until hours afterwards. Personally I will never go in the sun without at last SPF 30 again after my awful burn 6 years ago in Belize (and a subsequent sketchy mole that I had removed (turned out not to be canerous, but atypical, ie theoretically could have become cancerous at some point)) and now have a huge scar on my back from, in addition to the burn scars in the shap of the bathing suit I was wearing.. and okay I was out fishing a few weeks ago and I forgot to sunblock beyond my spf 15 moisturizer and came home with a racoon face...) but I see plenty of people do it all the time.
It would be easy to imagine that he put sunblock on the kid, didn't notice him getting burned, and by the time he got him home to his mom, it was too late.
Yeah, I guess second degree sun burns you DO turn really red but they don't start blistering (at least they didn't for me) until a day or two later.
He sure as hell isn't going to make that mistake again. It sort of sounds like a vindictive chick thing to me...
