I was going to post this in the old Gay Marriage thread, but the search function isn't working, so here it is:

A judge ruled Monday that California can no longer justify limiting marriage to a man and a woman, a legal milestone that if upheld on appeal would pave the way for the nation's most populous state to follow Massachusetts in allowing same-sex couples to wed.

In an opinion that had been awaited because of San Francisco's historical role as a gay rights battleground, San Francisco County Superior Court Judge Richard Kramer said that withholding marriage licenses from gays and lesbians is unconstitutional.

"It appears that no rational purpose exists for limiting marriage in this state to opposite-sex partners," Kramer wrote.

This should be a state's rights issue anyway.

Although the other side of that coin is that dozens of states now have ANTI-gay marriage amendments, largely because of the mass marriages in California and other jurisdictions.

The ONLY point I see against Gay marriage is it might be wrong to call it marriage by definition. But Unions are fine with me. I'd only want the Unions thing if it brought some of the religions right over to the pro gay marriage side.

But since I know they won't budge, let gays marry or whatever they want. They're adults, it's their lives and their money.

Well that's one of the BIG arguments I hear on Conservative talk, so I just wanted to bring it up. This is one of the few topic I agree with the other side on.

If you could get wide support for Gay Unions and just not call it marriage, wouldn't that be a good compromise?

But since I don't give 2 shits about the religious aspect of keeping the sanctity of marriage holy, fuck them in their Jesus holes.

The complaint about calling it a "marriage" is that the people arguing that somehow thing that allowing gay marriage opens the door for ANYTHING...triple marriages, people marrying animals, whatever...which is pretty ridiculous and insulting.

Agreed. I support Gay Marriage, but I would MUCH rather see it done through the legislature, not from the bench. The whole reason why we have legislatures is to sort out issues like this. This judge is making law which doesn't exist, based on his (and my) personal values. And that's a bad way to make law.

At issue were a 1977 law that defined marriage as "a personal relation arising out of a civil contract between a man and a woman," and a voter-approved measure in 2000 that amended the law to say more explicitly: "Only marriage between a man and a woman is valid or recognized in California."

Sounds to me like something well within the discretion of a Legislature. What clause of the California constitution did he cite this law violating?
