View Full Version : The Government Can Now Take Your Home....
<p><a href="http://www.msnbc.msn.com/id/8331097/" target="_blank">....to build a Wal-Mart, or whatever they feel like.</a></p><p>The Supreme Court on Thursday ruled that local governments may seize
people’s homes and businesses — even against their will — for private
economic development.</p><p>It was a decision fraught with huge
implications for a country with many areas, particularly the rapidly
growing urban and suburban areas, facing countervailing pressures of
development and property ownership rights.</p>
<p class="textBodyBlack">As
a result, cities now have wide power to bulldoze residences for
projects such as shopping malls and hotel complexes in order to
generate tax revenue.</p>
<p class="textBodyBlack">This was an excerpt from the dissent:</p>
<p class="textBodyBlack">“Any property may now be taken for the benefit of another private
party, but the fallout from this decision will not be random,” O’Connor
wrote. “The beneficiaries are likely to be those citizens with
disproportionate influence and power in the political process,
including large corporations and development firms.” <br />
</p>
<p class="textBodyBlack">That sounds like something
a liberal would say, but that was written by Sandra Day O'Connor, and
on her side were Clarence Thomas, William Rehnquist and Antonin Scalia.
I never thought I would be coming down on the side of guys like
Rehnquist, Thomas, and Scalia, but they rightly dissented against this
awful ruling. I have never been more disgusted with the liberals in the
Supreme Court as I am now.</p>
<p class="textBodyBlack">I can't imagine what horrible consequences
this will have. If a town wants to get rid of a bunch of low-income
owners, just take their land and give it to someone else. This is
making me angry.<br />

yea but if you're a renter, you get your deposits back, and rent some
other place. its actually easier cause they just move basically. owners
usually end up having to rent while they find a place to buy, spend
money, and end up living somewhere not quite as nice as they did<br />

build on land people live on, they go to them and offer them way over
market value to avoid any problems. Now there will be no problems. Go
to the city, get them to seize the land, and you only have to pay
market value, and people will have to take whether they want to move or

for economic purposes, but I'm not sure how this ruling affects that.</p><p>As
far as the court ruling, its final. Each city has its own procedures so
I'm sure there will be some sort of recourse people will
have.<br />

If all the land where low income housing is was taken away for new construction of Wetzel's Pretzels and Lidz stores, and you can't afford the only stuff left to rent, you're forced out of that area.

well states still can write laws forbidding it. The courts still left it in the states hands if they wanted to outlaw it. If a state doesnt outlaw it then that just sucks for them. See this is why conservative judges are sometimes better for Supreme Court because they are strict constructionists and dont follow their own ideas they follow the constitution like you are supposed. <p>So government can pay people fair value - then private contractor X can say we will pay 4x market value and the local gov't can say it is for betterment and you are ghost from your house. The city anounced that a certain area would be annexed. They said they would pay the homeowners fair market value. The catch was, they said this would happen in 5 years. Five years later, the value of the land was drastically low, because everyone knew the land would be taken by the city. In the end, the owners didn't get much of anything.</p><p> </p>

<p>I can understand both sides of the arguement. It is my understanding that the scope of private builder seizure power is limited to land which clearly demonstrates a significant economic value to the local community. This means they can't just take anyone's house unless they can prove that the tax revenue generated from the new property will significantly help to improve the local community. Look, we may live in a free society, but that doesn't mean one can snatch up all the good land for themselves and leave the rest of the town to flounder. This was the case here. It brings to mind the image of the lady who refuses to sell her home in the big city and years later you see it flanked by skyscrapers. It's kind of silly but it happens, and the community pays for it. </p><p>The point becomes moot when you consider New York City, which has some of the highest real estate taxes in the country, still has significant social issues that have yet to be alleviated by all this money flowing back into the local government (homeless, bad schools, etc.). Local governments are not reknowned for allocating funds where people actually need them (take for example Bloomberg's idiotic plan to build a stadium on the west side highway....you fucking moron, like traffic isn't shitty enough in the city). </p><p>That and people shouldn't be kicked out of thier homes.</p><p>My issue is this...I believe this also opens up privately owned land which has been purchased by non-profit organizations to save wildlife habitats for purchase, which could take away thier power to save such habitats. </p>
