<p>I don't know if <a href="http://www.washingtonpost.com/wp-dyn/content/article/2005/08/11/AR2005081102079.html" target="_self">this</a> is good or not good. Where is Superstar when you need him?</p><p>The Judge does make a good point.</p><p class="textBodyBlack">The state law presumes that someone with a blood alcohol content of 0.08 or higher is intoxicated, denying their right to a presumption of innocence, Judge Ian O'Flaherty ruled in dismissing charges against at least two alleged drunken drivers last month.</p><p class="textBodyBlack">This Story is taking place in VA. Judge O'Flaherty is getting crazy heat from M.A.D.D. -</p>

he is right though, the fact that the number automatically makes you intoxicated does take away presumption of innocence<br />

<p>I will abstain from commenting on this......OK no I won't.</p><p>It will NEVER hold up. Presumption of innocence is tough. The law states that you can not drink and drive. at .08 you are deemed guitly but you can get a DWI at a reading LOWER than that (at least in NJ) They take into account your field sobriety test and speech and a number of other things that are completely up to the officers discretion. </p><p>I've been popped for DWI's twice. YES I know how stupid it was. I also know that if I had gotten out of it I would probably still be doing it. The fines are immense but it is nothing in comparison to what could have happened. OK now I'm done. </p>

right. I wouldnt mind seeing it go back to .10 though cause alot of
people arent intoxicated at .08</p><p> </p>

I've had this argument before about how alcohol effects every person differently. BUT the more I argue my point the more i see the futility in it. You're better off not drinking at all if you are going to drive. It really does just make sense (the way the laws are). I aspire to open a bar/taxi service. I'd make a killing.</p><p>When I do get my license back I have to have a breathalyzer on my car that will not allow it to start unless I blow a .05 or lower. Then it goes off at random intervals and I have to blow into it again. That should be fun on my hour plus drive to work. BUT I brought it on myself so......<br /></p>

BUT, it can be thrown out by a judge if you decide go to court...<br />Your assumption of guilt is made by the cop on the spot who wrote your ticket. They do it all the time. DWI is no different. Your gulity.</p>

If you show up to court for the speeding ticket, you can argue your case. You can also argue your case with a DWI. You're not guilty until the judge says you are. If you Have a good argument (or a good lawyer) on your side, you can win.</p><p>This is why so many celebrities refuse to take a breath test. If they do refuse, then the cop has to prove they were drunk. Be it speeding or DWI... it all boils down to "can you afford to get yourself out the shit, you just got yourself into".<br /></p>

Drving isn't a right so even if .01 doesn't make you intoxicated to the point where it affects your ability to drive, it still not allowed since you don't have a right to drive.</font></p><p><font size="2">Also, add in that you have to speak english and be able to read before you are allowed to drive in an english speaking country with road signs that contain words.</font></p>
