<p>Just heard it on the radio. Woah! I'm shocked. Usually you'd elevate
someone already serving, with experience on the supreme court. There's
still a vacancy with O'Connor retiring, but they'll name someone soon. </p><p>I dont think the post carries much extra authority, its more ceremonial. But I'm not sure. I'll have to find out more. </p><p><br />

<p>The chief justice casts only one vote on the nine-member court but
wields influence in important ways. As the titular leader, the chief
justice can try to set a tone and philosophical direction. When in the
majority on a case, the chief chooses which justice writes the
decision, shaping the contours and scope of a ruling. The chief also
runs the court's administrative functions as well as those of the
broader federal judiciary.</p>
<p>With Rehnquist's death, the senior
associate justice fills in as chief -- in this case Justice John Paul
Stevens, the court's most consistent liberal voice. For that reason
alone, Republican advisers said, the White House will be eager to get a
replacement for Rehnquist in place. Also, an eight-member court can
divide on 4 to 4 votes that would let lower court decisions stand
without setting precedent.</p>

only three previous Chief Justices rised from the Associate Justice post
to become Chief. (not including Rutledge who was interim) It is actually very unusual for it to
happen, so this is not out of the ordinary at all. </font></font><p><font color="black"> </font></p><p><font color="black">It
doesnt carry "extra" authority perse but they do get to decide who will
right the majority opinion if they are in the majority which basically
sets the tone for Law because it could vary depending on who writes it.<br />

<p>The only sitting justices Bush would have considered elevating were Scalia and Thomas, and neither one of them has a sufficiently collegial temperment or enough respect for other members of the court to make their appointment a possibility. Incidentally, as the titular head of the federal judiciary, the CJ does issue an annual report on the state of the federal courts and is sort of the standard bearer for the role of the judiciary in goverment. Renquist, for all his conservatism, was admirable in his defense of the federal bench against half assed charges of judicial activism brought by the radical right, most notably Tom Delay. </p>
If he didn't nominate Roberts or Rehnquist's
replacement for Chief we would have to suffer through three different
confirmation hearings. Putting Thomas or Scalia up there in front of
Congress would have been a slugfest I could do without.<br />

Given Bush's history of cronyism and apppointing to head institutions people who have long histories of trying to undermine or destroy those institutions, I expect Bush to nominate Ken Lay as Chief Justice.
