<p>From a personal standpoint, dare I say SPECULATION, I think a lot of
people are overreacting about this AOTM and what happened.&nbsp; Here
are some facts in the situation.</p><p>1) The individual involved in
the AOTM was not charged with a single thing.&nbsp; Not assault, not
even disorderly conduct.&nbsp; He wasn't even held.&nbsp; Questioned
and released.&nbsp; Even the people in Sex for Sam were held on
disorderly, and there was no &quot;victim&quot; there.<br />
</p><p>2) For Mr. Johnson to suffer permanent hearing loss, his ear
drum would have to be blown somehow. Because of the wonders of biology,
our ears do have safeguards against short periods of loud noises.&nbsp;
To suffer permanent hearing loss (tinnitus) you'd have to have an
airhorn blown in your ear non-stop for a long while.&nbsp;It's an automatic reaction - LOUD SOUND - hand goes to ear. <br />

A blown eardrum would have meant blood coming from the ear canal.&nbsp;
If there was blood coming from the ear canal - that is assault.</p><p>3) Not a single article I've read has stated that Mr. Johnson went to any sort of medical facility.</p><p>4)
Dick Codey has a hard-on for going after Shock Jocks.&nbsp; He enjoys
getting his name in the paper.&nbsp; It's interesting, considering that
this assault happened in Ocean Township, which is about 10 miles away
from the Asbury Park Press's headquarters, that the Star Ledger - HQ'ed
in NEWARK - writes this story.&nbsp; Oh, did I mention that Dick Codey
has the Star Ledger in his back pocket?&nbsp;</p><p>5) From a
managerial standpoint, O&amp;A did what they were told.&nbsp; When
Logan told them to stop the contest, they immediately backed off of it
and hadn't mentioned it.</p><p>&nbsp;</p><p>I think this can be entitled &quot;The Media Strikes Back&quot;.</p><p>&nbsp;</p>

there are not a lot of things making sense.&nbsp; It's been over 24
hours since this happened, and still no arrest.&nbsp; They said that
WABC can pursue disorderly if they want... is there a double jeopardy
if they are trying to make a play for assault from the same incident?</p><p>&nbsp;</p><p>&nbsp;</p>

Yes, yesterday after they played a clip of Stern on the Today Show where they said Howard is the first shock jock on satellite, Opie got pissed off and called for an assault on the Today Show.<br />

<p>Companies are very touchy today and I really don't think that XM is any different&nbsp;then&nbsp;Infinity or Clear Channel when it comes to their certain types of knee jerk reactions.&nbsp; </p><p>I think everyone knows that they are 99% NOT going to get fired but NO ONE wants to go through the WNEW days.</p><p>I like my life the way it is.</p>

<p>If we were just talking about this thing as a stand alone incident, I'd say there's probably nothing to it. </p><p>But, it's this, in addition to an already for lack of a better term, shaky history, in the radio business. They've been fired twice for stunts. Nobody knows how XM thinks, and what they ultimately feel the Opie and Anthony show means to thier company. They could be very skiddish about this just being the 'gateway' to future trouble</p><p>The best way to gauge the situation is this: </p><p>If the story dies in a couple days, everything will be fine. However, if the guy involved in this decides to press charges against XM for&nbsp;negligence or whatever legal grounds there may be (and I'm sure there's something he could at least try to pursue)&nbsp;in addition to the pest that did the stunt, then that's when the shit may hit the fan because it'll definitely become a national story, and one that would most likely hurt XM. I can see the headlines now:</p><p>&quot;St. Pat's Sex Stunt Duo At It Again&quot;</p><p>If it spirals out of control that way, then it may force thier hand. </p><p>You're right, it's probably nothing, but there's at least the potential for this to fly out of control. The news loves a scandal. </p>

If terminating O&amp;A will avert an amount of liability that is more than the projected profit from keeping them on, then O&amp;A will survive. It&rsquo;s as simple as that. Do they bring XM more money than they cost XM? If yes, then they stay. If no, then they leave. </font></p><p><font size="2">If the direct costs of running the O&amp;A show, coupled with the potential for lawsuit damages, is less than the sales attributable to the show, then they will be fired. Otherwise, they&rsquo;re not going anywhere. </font></p><p><font size="2">Again, love the show, and I'd like to extend a big &quot;hello&quot; to the board.</font></p>
