I saw a newsclip on CNN showing these radical Christians protesting in front of funerals for Iraqi War dead veterans showing signs that read "Thank God for IEDs" and some shouting that the fallen soldier is in hell. Who the fuck made them God? I understand people being opposed to the war but this is beyond disgraceful. Some states are presenting legislation to ban protests like this

Gov. Tom Vilsack, traveling in the Middle East, enacted legislation
Monday outlawing protests near funerals in Iowa in hopes of sparing an
Ogden family from a planned anti-military demonstration today.<br /><br />The
new law bans disorderly conduct, such as loud, abusive language or
disruptive behavior, within 500 feet of a funeral, memorial service,
funeral procession or burial. It marked the first time Vilsack has
enacted legislation while not in the country, aides said.<br /><br />But a spokeswoman for the Westboro Baptist Church said the law will not keep the protesters from coming to Iowa.<br /><br />The
funeral for Iowa Army National Guard Sgt. Daniel L. Sesker, 22, is
scheduled for this morning at Ogden High School. Sesker, a gunner, was
killed near Tikrit, Iraq, when a roadside bomb exploded near his truck.<br /><br />Shirley
Phelps-Roper of the Westboro church said the new law would not impact
the protesters' message, noting they typically keep some distance from
memorial services and the ban should not affect their protest.<br /><br />"I
don't care what (the governor) did. We're on our way," she said. "We'll
obey the law. . . . It will change exactly nothing. If they think that
law has any success at stopping the punishing hand of God on this
nation, then the next thing they need to do is pass a law that
abolishes hell."<br /><br />The Topeka, Kan., group has protested at
numerous soldiers' funerals in recent months, including some in Iowa,
over the U.S. military's stance on homosexuals.<br /><br />The church
issued a press release Saturday about today's protest at Sesker's
funeral, saying "God hates (homosexuals) . . . Ergo, God hates America
and is killing and maiming her sons and daughters in retaliatory wrath
and vengeance."<br /><br />Phelps-Roper said the law, passed by Iowa's
"legislature Taliban," is unconstitutionally targeted at them and noted
last week's tornado that hit Iowa City as an example of God's anger
with Iowa.<br /><br />A prepared statement by the group called the bill a
"blatant violation of the First Amendment" and "in blasphemous
suppression of God's truth in the earth by criminalizing gospel
preaching."<br /><br />Vilsack left Iowa on Wednesday to visit U.S. troops in Afghanistan and Iraq.<br /><br />By
telephone on Monday, he authorized his electronic signature to be
placed on the bill after receiving an opinion from the Iowa attorney
general's office that the act would be valid, Vilsack spokeswoman
Jennifer Mullin said. Vilsack's exact location could not be given, she
said, because of security procedures.<br /><br />Mullin said that this is
the first time Vilsack had taken such an action, and that it was
perhaps the first time any Iowa governor had done so. Former Gov. Terry
Branstad never signed a bill while outside the state, let alone the
country, said Eric Woolson, Branstad's former press secretary.<br /><br />"I
have spoken to the Iowa families of fallen soldiers and have become

I don't know, man. Don't get me wrong, I list these people with the worst people on the face of the Earth, and I think what they do is irredeemably despicable, but I'm not sure if I'm in favor of this kind of law. It just makes me a little uncomfortable. It's like Ronnie says about the smoking ban and the Texas drunk in public/bar situation, it's also you're own rights that you're giving up. Like when this Shirley Phelps-Roper waste dies, I might wanna go and protest at her funeral and burn the bible or something, you know? Or maybe one of her kids, wouldn't that be great?<br />

Who cares if kids see 2 people of the same sex kissing or hugging or holding hands or whatever is so "awful" to people like "LordofIron?" If your kid asks why they were doing that, why can't you just say "because they're in love" and move on? People act like you have to sit down then explain in graphic detail a guy getting blasted up the ass by another guy. The point is to propose the bill knowing it's going to fail and get as much publicity for the issue as possible, (wasting as much of Congress' time as possible with bigotted floor speeches about the sanctity of "traditional marriage" - a term that never really existed before the last elections), whipping up homophobic Christian conservatives on their crusade against gay marriage. Then the ammendment fails, the homophobes are disgusted that they live in a country that doesn't hate fags enough to prevent them from getting married, states put anti-gay marriage ammendments on their state ballots, which brings out the Christian conservative homophobes to the polls and in the process they vote for the repubicans on the ballot.</p><p>It's a political tactic that helped Bush a great deal in 2000. But it is the republican party threatening to ammend the Constitution to restrict the rights of Americans for the first time since prohibition in order to win more votes. </p><p>And it works why? Because conservative Christian homophobes are a big enough part of the republican base to make it worth their while to expend this amount political capital on them. </p><p>Bush doesn't represent all Christians, I agree. Not all Christians are homophobes, I agree. Not all Christians are republicans. But there are enough people who hold watered-down versions of the Phelps' views to make them a giant political force in America. </p><p>The homophobe vote is a big one.</p>

Honestly, religion in general can be looked at as a joke. really, what is religion. everybody has their on concept to what they believe is real and they are all pretty damn hardheaded to their ways. Isn't Phelps-Roper her maiden and married name? It was strange because there was another member that was a guy with either the last name Phelps or Roper singularly. Unless that was her son and she gave him a douchy middle name or a nephew of some sort. Either way they showed them in front of the state building with about ten kids protesting with god hates fags on their signs. They are standing at the entrance of the cemetary with signs and state troopers making sure nothing happens. From R&F I knew these people were cunts, but seeing how fucking close they are to these funerals in amazing. I have a close friend in the military and I have to give the soldiers families credit. I wonder if she and the rest of Westboro Baptist realize how close they may be to death. I would think there is some crazy soldier out there who may not take too kindly to this. Maybe she missed the Vietnam War where she could call returning soldiers baby killers and spit on them. </p>

Great doc...Louis Theriox nails it pretty much, I think in regards to these people.
They're vindicated in the hate people show towards them, because they're taught that the world hates them and is evil from the beginning of their lives.
And they're all very close knit, and kept together, in a cult-esque fashion to where they don't get a chance to experience any type of normalcy in the outside world.

I think Louis says it in the film...you can find pretty much anything in the Bible that you can bend to your own will as far as making your opinion on things seem authoritative.
It's about that guy, 'Gramps', and his demons within that drove him to start this ministry.
Something seriously fucked up must have happened to 'Gramps' back in the day, because he's the source of all of it...everyone else is just an extension of his anger, basically being used to do his bidding.
They've all been programmed, even Shirley...because it's not like they're just flat out evil people from the way it's portrayed...outside of the ministry bullshit, they seem fairly personable...it's just they've had the ideas of 'Gramps' driven into their heads from birth, so they accept without question and they fear what will happen to go against his will.
It's like the chick at the end...you can tell she's not happy, but at the same time, she can't comprehend anything outside of her current lifestyle. That is the dead giveaway that these kids are raised in some hardcore cult-esque surroundings their entire lives.
And the longer they're in it, the more impossible it becomes to bring them back...like, I don't think any amount of reasoning could bring Shirley back at this point...she's too deep. Even her older kids are on the bubble, even though they seem to have some conflict at times with the situation, because they've just had it cemented in them for so long.
The only ones that could probably be snapped out of it are the little kids, who still don't really know what's going on.

I understand your question, i would suggest that the burying, or other ritualistic rite, of a relative is such a fundamental act that it can and should be granted protection in terms of a right to peace. Its a cheesy thing to say but, your rights end where another persons rights begin, and this is tricky to define, particularly with respect to honoring your dead family members, but I think it is important that we, as a society, are allowed to greive in peace.

Yep, that was my first reaction too. As much as I might or might not disagree with someone's speech, thats irrelevant. It should be protected. I saw nothing in the story that led me to believe they did anything other than exercise their speech rights, however wrongheaded and poorly timed they were. Also, I guess the Federal laws banning these protests was passed retroactively, since this was a Federal lawsuit and I was under the impression these protests had stopped at the military funerals since the ban. In any case, I suspect the law is unconstitutional.
I'd appreciate one of our fine (or not so fine) counselors on this board to weigh in here.

I think the jury decision was correct, and will stand up to scrutiny in the courts.
1.The First Amendment gives you the right to say what you want, but does not give you the right to be listened to.
2. The Community Standards-the "I can't define pornography, but I know it when I see it"-stuff the court considers will allow the jury's decision to stand, because the community rejects hate speech and wants protections to keep from having it in their view when conducting personal business. It's one thing to stand on a streetcorner spewing this stuff, or any political view for that matter, it's another thing to go to a private function, uninvited and say it.

First, no one can keep up a court battle indefinitely. Yes, it could take awhile, and could get to the Supreme Court, but it will get finalized. Also, it costs a lot of money to make appeals. They're going to have to post a bond on the judgment while they are appealing, pay filing fees, etc.
Second, while the monetary award is big, the bigger win, I think, is the ruling that they are liable. That will likely stop them from doing such actions again rather than risk additional large judgments.

That's exactly it. They know the relatives and friends of the deceased are already emotionally distressed and vulnerable, and seek to increase that distress by saying that their loved one was damned by God because he/she fought for a country that accepts homosexuals.
Their "political"/religious message is that homosexuality is an abomination and we shouldn't accept it. They have a right to express that, but as with any right, there are limits. They may be liable for damage caused by expressing that message.
I generally have a right to chop down a tree in my yard, but if I do so in a way that makes the tree fall down into my neighbor's yard causing damage to the neighbor's property, and I intended it to do so, I'll have to pay for the damage.

Maybe. The rationale as to why racial comments are outrageous conduct probably applies to other similar types of discriminatory speech.

Yes, but in certain ways, they are "purer" 1st Amendment cases, where they opposed a government action/regulation infringing outrageous speech. This is a civil lawsuit between two non-governmental parties where it's clear that the defendant is actually trying to harm vulnerable people through speech.

You're completely ignoring the legal framework that EliSnow has so helpfully spelled out in this thread. The ACLU doesn't take cases where people are blatantly attacking others in a time of extreme emotional distress in what essentially a very private moment. It's not like these people are fighting for their right to march down a street or have a rally in a park or a public auditorium or anything along those lines, all cases that the ACLU has fought for, on all sides of the political spectrum (neo-nazis, hello? It's not more extreme "right wing" than that).

I get your point, but wait a minute. They weren't protesting that dead soldier for anything about him individually, his funeral was just an opportunity for them to make their political protest. If the signs read "God Hates Joe Smith", then they are attacking him as an individual. But thats not what they did, they attacked America as a country, the military as an institution, and homosexuals for their sexual orientation. Sounds like broadly targeted, political speech to me. If its not political speech, I'll show you some of the signs people were carrying at the anti war marches here in NYC a few years back. Pretty vile, hateful stuff. But protected nonetheless, as it should be.

The only possible legal difference that I can see is that Falwell is a public figure while soldiers are not. However, as much as I dislike the man's public statements, I would hope the rights of Falwell's family to keep his funeral a private time and place for mourning would trump any conflicting right to express disagreements with his public positions. Afterall, if the man is dead you can't claim to be trying to protest the man, but only those who are mourning his death. Same as the soldiers' funerals. Whether the legal battle would be defined on those terms or not, I don't know.
Oh yeah, and I read in the local paper that the family said it plans to continue to protest soldiers' funerals. They just may dig themselves into a hole so deep that nobody can hear them at all anymore.

There are several points here that I addressed above. First, yes, I think the abortion doctor could sue if the actions cause severe emotional distress. Now, it could be argued that because the doctor was a doctor who performed abortions, his family was probably used to those type of protests, and thus the demonstration would not cause severe emotional distress.

As to the next point, there are several imporant points here. First, there is a difference between this situation and having protests at gay events in that the people at a gay event are not vulnerable to severe emotional distress. Look at the factors I cited before, one of which was the plaintiff was vulnerable (emotionally) and the defendant(s) knew it, and went forward with their conduct. A funeral is a tremendous emotionally distressful event for the friends and relatives, especially when it's a young man or woman who has been killed as most of the dead soldiers are. You don't have the same emotional vulnerability at a public gay event.
Next, as I said, the claim requires that the actions must cause severe emotional distress --not just a "stressful situation." Yes, anti-gay demonstrators protesting at a gay event would cause some distress, but not the severe emotional distress that the law requires. And yes, there are standards to determining severe emotional distress, and they are high.
That's why I noted above that the church may be able to show on appeal that the plaintiffs failed to prove that the church caused severe emotional distress.
And finally, as to how this decision could "fuck others," it's a case easily distinguishable by its facts. It's use of speech at a funeral to cause emotional distress. Very few events have the same potential for such distress. Judges distinguish cases all the time, and I think this one is distinguishable, so it won't become a "slippery slope."

There is a difference between your examples. You have to see their messages along with the context of their messages, as I said above. They are at the the funeral of someone who was killed fighting for an institution that they say God hates and is punishing. The clear import of their actions and message is that God is punishing the soldiers for fighting for America.
And if there wasn't some sort of personal component, then why are their protests at funerals of dead soldiers, rather than on public streets etc?
And for Yerdaddy example to be similar, you would have to go to Yerdaddy's funeral and say that God hates logic, and punishes those who use it.

The way Ron deals with Shirley Phelps-Roper is one of my favorite things about the Ron & Fez show. Everytime she's on any other show or on television, people try to have some sort of intelligent (ha!) discussion with her and it ends up in just people yelling at her, and Shirley looking like the sane one.

I know what I'm missing. Everytime she's on I give it a couple minutes until I can't take it anymore. Ron does make her look foolish at every turn, I just don't want to hear it. If a majority of you enjoy it, then enjoy it. She's so horrible and wrong that I can't take it.

Neither did I. But its on Showtime and replaying quite a bit.
I thought Showtime had good documentaries yesterday because I woke up and watched a Intelligent Design v Evolution documentary, then I hear Ron & Fez talking about the Phelps one. Showtime rules.

I know a lot of listeners are repulsed by her and change the channel while she is on Ron & Fez. I like her. She puts herself out there with her insane ramblings and picket signs. Nothing to hide.
I am much more disappointed and depressed with humanity when I see an H2, or listen to Top 20 on 20, or when their is some homophobe with abysmal grammar commenting on Youtube, or when someone wants to teach creationism in science class, etc., etc.

I am amazed at how unflappable she is. Ron comes at her with a comment and she is on it really quickly. Say what you want but she is almost as unflappable as Ron.

I live Kansas City, not far from Topeka where carzy phelps lives. I work next to a building next to a large cemetery. Last week we witnessed a full military funeral for a young man killed in Iraq. 21 gun, taps and all. It was quite moving even from our 8th floor window.
Her group of crazies was protesting outside of the funeral near an om ramp. Ages 7 to 70 had the "God hates fags" sign among others. It was very sad.
The moving part was the biker group, Patriot Guard that lined the cemetery with flags as they brought the body through. About 50 bikers with flags lining the road.
