I think someone got into an accident, go t hurt and has some pretty good meds to take care of the pain. I hope you are OK Skellington. Tell us more please.

richg0404 wrote: I think someone got into an accident, go t hurt and has some pretty good meds to take care of the pain.I hope you are OK Skellington.Tell us more please. aug 13th, the brakes on my new car failed while i was on a exit ramp.  i have a fractured ischium (lower pelvis) fissured fractured condial (top of femur) and a herniated disc in my back that mashed into nerves and i have no feeling in my right leg and if i try to stand up straight, my right leg goes paralyzed.  I still can wipe my own butt and i still have bladder control.  But i have to walk with a cane because i can't stand straight and my leg drags if i don't pay attention to it.   But yes, i have very fine medication (vicodin, medrol) but now i get xanax because of all the MRI's (insurance only approves one part of the body to MRI'd at a time).  Xanax is the first med that totally took all the pain away because...i just went to sleep for 4 hours and didn't budge.  wheeeee.  And can i sue?  No.  Because Toyota/Scion are some DIRTY ASS SNEAKY MOTHERFUCKERS.  But if you check the NHTSA.gov site, there are 9 or 10 complaints about brake failure in 2005 Scion tC's.  My new license plate is DTHTRAP.  Insurance didn't total my car even though the frame was bent.  I basically have a new car now.  And can advertise it's downfall.The other picture is my roommate's (best friend since i was 14) toyota corolla. She went to DC to pick up a drunk friend that i needed a ride.  On her way back, she was at a stop light and a drunk driver rear ended her and pushed her a quarter mile down the road.  The drunk driver got out of his brand new lexus and tried to play it off with some bullshit excuse.  He was promptly arrested because there was about 20 eyewitnesses and....he was fucking drunk.Case and point, if you drive a 2005 AUTOMATIC Scion tC, drive with care.  If you are drunk, don't fucking drive.  I love my roommate and almost had a heart attack when  my cripple ass had to retrieve her from the scene.

This is one of those instances where the the justice system is supposed to work on your behalf.  If you can afford to do it, I'd look into getting compensation for the defect in your car.  The last thing the company wants is any publicity of "this can happen to you if you drive our car".I hope you can recover fully.

the bullshit thing is, the tire that proved the ABS didn't engage was 'missing' when i got my car from the shop.  The car's internal computer was 'reset'.  I'm pretty convinced when the Scion rep was at the shop taking 'notes and pictures' of my car, he was actually passing 'notes' to the bodyshop and 'tinkering' with the cars innards.  I wasn't even warned of his visit to the shop.  Without proof, i don't have a case.  In Virginia, in order to sue, you have to prove without a doubt that it was the car's mechanical failure that caused the accident, not me.  Since i have a history of speeding (not on fucking exit ramps....) my ass is toast in court.  I won't get anything because it will be pointing out that  i have a history of driving like a ass.  I have NEVER been in an accident though.  EVER.  But since i don't have anything proving the stupid brakes did not work, i don't have a case.  I begged the body shop to find the parts.  It looks like i'm pretty much screwed until this happens to another person and they are smart enough to just take the parts off the car themselves, or are mechanics themselves and can prove this shit.  But trust me, my brake was to the floor and nothing was happening.  So this is all just a waiting game for NHTSA.gov to issue a investigation on the 10 complaints of brake failure.  I doubt toyota will do the right thing because they already sent me a crappy ass letter stating "sorry to hear about your accident, there is nothing wrong with your car, happy you aren't injured".  They know i'm fucking injured, they have records, they just don't want to admit it.  They already pulled the 2007 tC's from being released and last minute too take the EBD off.  Fancy that.  For right now i'm just going to be grumpy the gimp and take my pain med's.  If i can find a lawyer that thinks i have a case, game on.  For sure if a recall is issued, i'm suing the panties off toyota.  Until then, i wait.  Like crouching tiger...hidden dragon...grrr.  *shakes cane*

It's true - the negligence laws in DC, MD and VA are not at all plaintiff-friendly. But you'd probably be able to sue in a different forum where the laws aren't so skewed - say NY for instance, or wherever Toyota/Scion's North American Headquarters are. You could also sue the manufacturer who made the individual malfunctioning part.

I'm sure that others on the board more familiar with law can point you in a better direction, but there are tort lawyers out there who would probably consider taking a look at your case to see if there are other instances of this to warrant a class action suit.The downside is that in a lot of class actions suits, the actual people involved don't get much of the money after it's split up amount the lawyers in various states who are chained in to the suit.

Check your PM I sent you. The best spine doctors are in Germany. Bertagnoli & Zeegers if you're paying out of pocket. If not, get to New York or Texas. There's a bunch of good ones there like Horthshuler(sp?) in Texas and Dr. Yue in Connecticut, Cammisa in NY, and Jeff Goldstein who is mine in NY. adrsupport.org helped me out alot in my decision to get an artificial disc (Prodisc). I'm still fighting the insurance company but since it's worker's comp, I have leverage.I take 240mg. of Oxycontin20mg. Valium1800-2100mg. of Neurontin(Gabapentin) which is a nerve blocker which may help your leg pain. It helped mine ALOT.DONT LET THEM FUSE YOU!
