<p>This is one of those instances where the the justice system is supposed to work on your behalf.&nbsp; If you can afford to do it, I'd look into getting compensation for the defect in your car.&nbsp; The last thing the company wants is any publicity of &quot;this can happen to you if you drive our car&quot;.</p><p>I hope you can recover fully.</p>

the bullshit thing is, the tire that proved the ABS didn't engage was 'missing' when i got my car from the shop.&nbsp; The car's internal computer was 'reset'.&nbsp; I'm pretty convinced when the Scion rep was at the shop taking 'notes and pictures' of my car, he was actually passing 'notes' to the bodyshop and 'tinkering' with the cars innards.&nbsp; I wasn't even warned of his visit to the shop.&nbsp; Without proof, i don't have a case.&nbsp; In Virginia, in order to sue, you have to prove without a doubt that it was the car's mechanical failure that caused the accident, not me.&nbsp; Since i have a history of speeding (not on fucking exit ramps....) my ass is toast in court.&nbsp; I won't get anything because it will be pointing out that&nbsp; i have a history of driving like a ass.&nbsp; I have NEVER been in an accident though.&nbsp; EVER.&nbsp; But since i don't have anything proving the stupid brakes did not work, i don't have a case.&nbsp; I begged the body shop to find the parts.&nbsp; It looks like i'm pretty much screwed until this happens to another person and they are smart enough to just take the parts off the car themselves, or are mechanics themselves and can prove this shit.&nbsp; But trust me, my brake was to the floor and nothing was happening.&nbsp; So this is all just a waiting game for NHTSA.gov to issue a investigation on the 10 complaints of brake failure.&nbsp; I doubt toyota will do the right thing because they already sent me a crappy ass letter stating &quot;sorry to hear about your accident, there is nothing wrong with your car, happy you aren't injured&quot;.&nbsp; They know i'm fucking injured, they have records, they just don't want to admit it.&nbsp; They already pulled the 2007 tC's from being released and last minute too take the EBD off.&nbsp; Fancy that.&nbsp; For right now i'm just going to be grumpy the gimp and take my pain med's.&nbsp; If i can find a lawyer that thinks i have a case, game on.&nbsp; For sure if a recall is issued, i'm suing the panties off toyota.&nbsp; Until then, i wait.&nbsp; Like crouching tiger...hidden dragon...grrr.&nbsp; *shakes cane*

It's true - the negligence laws in DC, MD and VA are not at all plaintiff-friendly. But you'd probably be able to sue in a different forum where the laws aren't so skewed - say NY for instance, or wherever Toyota/Scion's North American Headquarters are. You could also sue the manufacturer who made the individual malfunctioning part.

There's a bunch of good ones there like Horthshuler(sp?) in Texas and Dr. Yue in Connecticut, Cammisa in NY, and Jeff Goldstein who is mine in NY. adrsupport.org helped me out alot in my decision to get an artificial disc (Prodisc). I'm still fighting the insurance company but since it's worker's comp, I have leverage.</p><p>I take 240mg. of Oxycontin</p><p>20mg. Valium</p><p>1800-2100mg. of Neurontin(Gabapentin) which is a nerve blocker which&nbsp;may help your leg pain. It helped mine ALOT.</p><p>DONT LET THEM FUSE YOU!</p>
