<strong>When I first heard Dave tell his story about his landlord I was on his side but when he revealed the water problem(reluctintly)my views changed. He should have told the owners.</strong>

Yeah he should have told them about the leak. They can sue him for the money lost for property due to the leak. I dont know about water bill. He still has them by the nuts cause the apt is illegal.

<strong>lets say the drain got clogged and the apt. filled with water.Everything on the floor,tiles,rugs,ruined.and depending how high the water rises other items like electricial outlets destroyed.Any judge hearing this case would rule in favor of the owners.</strong>

Both ESD and the landlord are wrong....but what kind of dim bulb does not tell the landlord about water leaking and at the same time you could tell them the heat is off...He has an apartment with no lease-big mistake...this bit has alot of holes

<strong>The reason why dave had no heat was because he let the water run there by emptying the boilerand never giving the water a chance to heat up. ( some plumbing experience)</strong>

he is probably living in an illegal apartment anyway so I don't think either of them would have a leg to stand on in court.

in daves case maybe the leak affected his heat. if it is steam heat they might be related. just a theory. ESD should really move though. he'd be much happier.

If more than one tennant is having troubles, they should all complain to that slumlord seperately, then all go to one of those tv "expose them for the a**es they are" shows, and I bet things would change. Either,Dave and all the tennants would be tossed out (which could be illegal), or the place would be brought up to code and the tennants should at least get a break on the rent for the duration of the repairs.

They can sue you for the difference.

Yup, usually in small claims. But if this was an illegal apartment to start with, they're not going to sue.

before I bought my current house the last landlord I had accepted/asked for an $800.00 non-refundable deposit to hold the place I wanted,when I went in to sign the lease the first line of the lease said NO SMOKING ON THE PREMESiS...boy was I pissed I defied them to enforce that condition!:furious:

also in NYC it's almost impossible to get money from a tenant...

I'm a landlord and my lease says that everything in my duplex is on working order when the lessor takes posession of the property. If it ceases to work from that point forward I am not responsible until I am notified nor am I responsible for anything in the rental unit for ANY reason. My insurance covers the dwelling only, NO property within for ANY reason. If ESD's landlord if worth the the paper the rental agreement/lease was signed on Dave's up shit creek without a paddle.

Based on previous conversations on the show, it sounds like there was no rental agreement/lease. It sounded more like an informal/illegal dwelling type of thing. He's not getting his deposit back, but he's not going to get sued.
Edit: Meh, Angrymissy pretty much already said what I thought. Oh well, guess I shoulda read first.
