During the storm this weekend, my fathers tree fell and landed on a neighbors shed, damaging it.
The neighbor is getting estimates on the repair of the shed.
My father wants to know if he will have to pay for the shed's repair, in addition to removing the tree and fixing the fence. Will my fathers home owners insurance cover it?
Will the neighbors insurance cover just his shed?
My father wants to know where his responsibility ends or what he is liable for.

F_S Had A Tree Fall On His House Three Years Ago. It Was A Tree On His Own Property That Hit His Own House, And Fat's Insurance Company Paid For The Damages, No Questions Asked, Except For The Deductible.

F_S Would Guess That In Your Dad's Case, He Will File A Claim With His Insurance Company For The Damage To His Property; The Neighbor Will File A Claim With His Own Insurance For The Damage To His Property; And Then The Neighbor's Insurance Company Will Probably Try To Settle Up With Your Dad's Insurance Company.

No Matter What, It Is Hard To See How Your Dad Will Have To Pay For More Than The Deductible On His HomeOwners Policy.

Hopefully, Someone Who Actually Knows Something Will Answer This Thread Too!

I'm pretty sure your father is responsible for all the damage that happened, since it is his tree. He really should call whoever does his home owners insurance.

Dito. Your dad's insurance should cover it, but find out how much it is first. He may want to pay out of pocket. Those homeowners policies sometimes cancel you when you make claims.

I had something similar happen a few years ago. A large branch snapped off the tree in my backyard during a big thunderstorm and fell on the house down the hill from me. there was a small amount of damage to their roof. We both reported it to our respective insurance companies and, surprisingly to me, both said that it was the homeowner (and his insurance co.) that sustained the damage that was responsible for the costs. Apparently, it fell into the "act of God" clause and I guess God liked me more than them.
Had the tree been in bad shape and I didn't take the necessary steps to mitigate the risk I could have been held liable.

I don't know enough about insurance and insurance law to know if my experience represents the rule or the exception though.
