I got a speeding ticket, going 34 in a 25. That's 2 points on my license. The cop said someting about paying and not getting points put on my license, and therefore eliminatiing my insurance from going up.
How does this work?
Instead of mailing in the payment, go to the court date and make a "deal."
They'll usually wave the points if you pay a higher fine.
It's kind of like legalized bribery.

NJ is so Crooked, I got an Open Container Summons and had to go to Sea Bright. There were lawyers trying to Charge $500 to get people off Speeding DUIs and so Forth, jusy pay a Lawyer , then a Heavy Fine then you dont get points or a Record. It was like Big Business

Just show up at court early. Get a meeting with the prosecutor. You can usually get a deal for no belt, and court fees.
Be well dressed, polite, and explain your situation.
Just be warned. If you go 34 in my 25, WHERE MY KIDS PLAY...

not at all.
Actually what most prosecutors are doing are making it into this other fine that is $225 and no points and you are allowed to use it twice before points. This will be your likely outcome, so be prepared to pay like $225 the day of court, but you will receive no points.

I'm more than willing to pay 225 and have no points. I have a part time job, and don't have a lot of cash. Especially since I had to fix my car. So, 225 sound s a lot better than 400...

there is a new thing in NJ that most people do not know about. there is a mandatory charge for having points dropped. I think it is 250 dollars. then on top of that you pay court fees plus the fee for your new charges.
for you to lose those 2 points it will most likely cost you around 4 or 500.
your other option is to take the points, and then sign up for the NJ safe driver course which is run on saturdays. You can then submit the completed form to your insurance company and they will remove 2 points. it does not actually come off your license, but it does help with the insurance.
It is def not as cheap as you think it is going to be.

I don't know how it works in NJ, but in FL you can pay a lowered fine, if you take a class before the ticket date. You can take the class once a year, and no points come off your license. You can even take the class online, or rent the video at blockbuster.

First off, if you were in a school zone you might have a problem, but usually they will still give it to you. Be warned however the fine for this statute is much higher than the price of the summons for speeding. It is close to, if not a little over $500.00. It still goes on your driving history, and abstract, and can only be done twice. You wont get points.

The insurance companies can still use the violation against you for rates. 39:4-97.2 is still considered a moving violation.

Only time I got a ticket was for running a red light. I had my seatbelt off, so the cop said "I can write you up for the red light which is $90 + points, or the seatbelt for $75 and no points" Guess which one I chose?

If you end up getting the points, see if your state offers a defensive driving class. Mine does. It takes off 5 points.

If the court accepts your plea, ask the court administrator to put you on a time payment plan. They will divide the payment up for you, and you would have to pay it monthly, or weekly, however it is set up. Just dont miss a payment or a warrant will be issued for your arrest.

yeah, that's nit picking, unless you were really near a school, thats always a trap, isn't there a thing you can take,.. a defensive driving class, a one day deal and it nullifies the points?

June 17th. But I'm flat broke right now. And I'm making 7.40 an hour working part time. I'm going tot ry to pick up more hours, but it'll be hard too.

Also make sure you contact the court and contest the summons. They will usually give you a different court date, later than the one the officer gave you on the summons.

If the court accepts your plea, ask the court administrator to put you on a time payment plan. They will divide the payment up for you, and you would have to pay it monthly, or weekly, however it is set up. Just dont miss a payment or a warrant will be issued for your arrest.
Could I go over to the courthouse before my scheduled appointment to go and try to arrange for this in advance?

No, you have to plead guilty to the ammended offense in court first. Then you could arrange it.

i found out about plea bargaining when I went to court and it was kind of funny. a public defender asked the group of us "who has speeding tickets" we raised our hands and then he asked "who wants to plea bargain" and everyone else raised their hand so i did too.
I believe I spoke briely with the public defender but can't remember what was said. I was then called up in front of the judge and he says "mr soandso, you were caught illegally parked" or something to that affect. being I wasn't familiar with the process like an idiot I thought for a second that he had the wrong guy and I say "no I was caught speeding"
he gives me that look and says "NO mr soandso, you were caught illegally parked" and then it dawned on me this was what I was supposed to agree too and so I said "yeah that's right"
this judge wound up living around the corner from me and our daughters played softball and were in girlscouts together. I approached him and mentioned what happened but he didn't remember it

Here in Georgia, the law is that they can't give you a ticket for anything under 10mph over the limit... This doesn't apply to the state patrol, but you only see them on rural interstate highways...
My driver's ed teacher in High school even taught us this...

The whole thing just sucks cause I don't have the money to pay the higher insurance, and I'm too strapped for cash to pay the higher fine, though that will be less of a bargain then the insurance rate going up.

That's a very good point. I drive in residential neighborhoods A LOT. I always go the speed limit. It amazes me when some big SUV rides my bumper in my own neighborhood... then I see the same driver yell at someone to slow down, when he/she is in their own neighborhood.

I hate when people go flying down residential streets myself. But, to my defense(and it's not an excuse), it was while school was in session which means kids wouldn't be roaming the streets, and also, the road isn't a road that is in the corner of town that is really residential. I got pulled over by an office building, and the road is a 25 mph road that people commonly go 35 on.

few years back, we was in Florida for a Monsters of the Midday (at the time) for Miss Monster 2003, anyways, we left out of the hotel room going to the Cocoa Beach Expo and the road we was on was a 25mph zone. Us being new to the area, we missed the sign completely. There was a sharp right hand turn and when we went around the corner, we seen a line of cars pulled over on to the side of the road. A Florida State Trooper was standing in the middle of the road with a radar gun literally fingering people as they came around that turn. Caught us going 40 in a 25.....
we told the guy we was out of state, didnt know the area and we didnt see a sign. It was true, we didnt see a sign with 25 mph on it. we got the ticket, turned around and went back to find a sign. sure enough there was a sign.....so we went back through the speed trap and went on the the party and rocked it out till midnight.....

If they say no installments, then it's a judgment call.

The prosecutor does not deal with the payments, thats the court administrators job. You can try to speak with the court administrator first, and see if they would go for the payments before you plea, but usually they wont talk about paying the fines until you plead guilty to an offense.

It's a really tricky situation. If you have a job, and you're cordial, MAYBE the court will let you pay in installments.
I dunno. I can't give advice because every situation is different, especially with how fucked up Jersey auto insurance is.

In Maryland if you go to court and the cop that pulled you over doesn't show up your case is dismissed. I've had this happen a couple of times, but it's been years since my last ticket so it might not be the case anymore. When the cop did show up, I just pleaded guilty and had to pay the original fine and a $20 court fee and that was it. No points.

Worst case scenario: you get the points. Just take an insurance/ point reduction course. It's around $50 and 6 hours of trying to stay awake. Try to cut the deal @ court first.

Although, some companies have their own points system(i.e. Progressive) that wouldn't care if the 2 points were off or not, your insurance would still treat you as if they weren't.

Ouch. You might need an attorney. I think anything over 20 mph is a major fuck job. The attorney may be able to handle both tickets @ the same appearance. Sorry to say but, it won't be cheap. Good luck bro.

a couple months ago i got hit with a 55 in a 45 and I was doing 55. i went to court to plea bargain and new jersey just implemented a one time 250.00 surcharge for plea bargaining along with the violation fine and the court fee it would have been near 350 bucks.
i haven't had points on my license in approx 10 years, a great credit score, and no accidents in 20 years, so after talking over my options with the cop at the court I decided to just pay the fine and court fee which came out to 94 dollars.
it was cool to not have to wait and just pay the fine. we'll see how it goes as far as what my insurance company will do regarding the two points...

I checked for the license violation one and it says that I don't owe a thing, which confuses me. I'll have to call the court to figure that out I guess.
All in all, I expected it to be worse.

Go to your states motor vehicle website. Three speeders in 18 months is a mandatory suspension in most areas. Be careful. Did the 260. cover both violations? (or just the first)
