I had a buddy get busted for possession of pot and unlicensed whiskey (moonshine), he had two prior possession convictions, and missed not one, but two court dates. In the end, he spent 5 days in jail. I'm not going to upset about someone only spending 3 days in jail for a DUI related offense.

Pretty much. I was overly pissed that her original sentence was then decreased to like 23 or so days due to good behavior. Are you fucking kidding me? She wasn't even in jail to do her "good behavior" or whatever. I wonder how much ball sucking she did to get that.

i think this is a positive development...if she had served the full 23-day sentence, a good amount of people would have had sympathy for her. now that she escaped the legal system so quickly, there won't be a single person who will be able to say, "see, Paris CAN be normal and down-to-earth and last in jail like we would have had to."

Her sentence was unnecisarily punitive in the first place. I hear stories all the time about the jackass with 9 DWI convictions who manages to keep his license and avoid jail.
The Sheriff was quoted as saying: "My message to those who don't like celebrities is that punishing celebrities more than the average American is not justice." He's got a point. And all the people who are saying that anyone else would not have been afforded special consideration are correct, however, anyone else would have gotten the community service and probation in the first place.

There's a difference between driving on a suspended and driving on a suspended while on probation. Probation means that you have certain terms to follow. If you break those conditions, you go to jail. PERIOD.

It kind of ties into the only reasonable basis that I could see, before giving consideration to the fact that she was on probation, which was that the Judge viewed her driving as an act of contempt for the court.
Still, I'd be surprised if this Judge locks up every probation violator that he sees. Particularly for a first violation.

At first I was so pissed that they let her out for house arrest.
but now! This is even BETTER THAN IF SHE HAD NEVER BEEN RELEASED!
Thought she was able to weasel her way out of it with fucking $$$, had a glimmer of hope it was all over and now has to go back... even better. That Sheriff MUST have been paid off to let her out without consulting the judge or prosecutor. Hope he gets fucking fired.

They are obviously trying to prove a point. The judge ordered her to now do all 45 days. Well its not her fault that the jail let her go early. Why up her punishment even further?

I have a totally different view on this then everyone else I guess. Isn't it kind of cruel and unusual to release someone, give them a new punishment and then go back and give them the same old punishment. This seems very unfair and fucked up. What did she do that makes people hate her so much? She parties, makes fun of poor people, has alot of sex and DWI's. Thats 95% of the people I went to high school with. How many DWI's did she have? I know people that have had 3 and never spent more than a night in jail. Suspened licences I know alot of people that have been in accidents with a suspended license and not seen jail time. Putting people in jail for drugs and traffic violations is a waste of time and money. She was made an example out of. Anyone with a good lawyer should have been able to get out this.

Thats all I thought happened myself. I don't see what the big threat of her being on the steets or how teaching her a lesson is now gonna save society. Her crying makes everyone feel better about themselves somehow. Either way that whole system needs to be changed. 45 days for violating a suspened license, shouldn't the license be revoked, then like a 2 day jail sentance, and so on. 45 days seems like a huge jump.

The thing so many people " defending " her are missing is that yeah it is possible to commit a crime like this and only serve a few hours/days but that doesnt mean you have to.
She could be serving the whole 90 days acording to the law.
Also all we hear from her camp is that this shouldnt be this and this shouldnt be that but not once have I heard anybody fully admit that what she did was wrong.
There are 2 things I am confused about.
They keep saying that where she's being held is minimum security so how crowded is that part of the prison that she has to be released ?
Its not like they are making room for the gang-bangers. Violent criminals wouldnt be held in that prison so unless there's a run on non-violent parole breakers lets schedule these sentences so that we can accomodate all of them.
Also I dont understand how legally they can file a habeus corpus petition.
She's not being tried for a new crime. What can be appealed ? Shouldnt only a legal action be appealed ? What the Sheriff did wasn't judicial s how can it face an appeal ? If anything the prosecution should've been allowed to appeal her early release.
This part baffles me. A " where's the body " motion when the conviction has already been affirmed ?
If the appeals court even hears this case it's a joke.
And if in the end she doesnt have to go back I hope the Deputies union pulls a little blue flu ( or in their case a green and tan flu ) action.
Refuse to arrest or bring anybody to trial.
The Sheriff saying things like " this girl was sick and needed help ". How many other people are in his jail that are worse off and he could give a shit about ?
I heard some city official say it right. Something along the lines that if this was able to go on there'd be 22,000 cases of suicide watch and hysteria w/ people looking to get out of jail.
Also all this talk about her writing a book is silly. Who'd buy it ? Even those that love this kinda story couldnt be tempteted to read it as it wouldnt have any substance. How revealing could it be ?

I love the high horse some of you seem to be riding on. I dont drink I hate the taste of the shit, and agree driving drunk is bad. But come on, I would bet every $$$$$ I have that most of you have driven drunk or tipsy or atleast over the low limit of.08? Once again no one should but so many people do it have done it and will continue to do it. I think we need to worry about the real drunks that drive with a .20 and higher those are the fuckers that cause serious accidents. .08 on her body frame could be 1 drink (seriously).
And I love how some of you think the prison officials were paid off b/c they let her out early. Watch some tv and listen to the lawyers from LA. They have all said that once you are in the jail system it is up to the jail to decide when to release and they have also said that this is normal on a 45 day sentence to be let out within 10% of the actual sentence.

Snacks the BAC count has to do with the amount of alcohol in your blood so her size is basically irrelevant. Its still the amount of alcohol she consumed in relation to the amount of blood in her body.
So unless she's only pumping a quart of blood through her it's doubtful she was legally drunk after 1 drink.
I dont remember the exact numbers, and this was based on a .10 being illegal, but I believe that it would take something like 3.5 beers ( or the equivalent alcohol in wine or a shot ) in an hour to get a man of about 185 pounds legally drunk. Having 1 beer every hour after that would remain at about .10.
So again she'd have to weigh probably 50+ pounds to be drunk on one drink unless she chugged some gain alcohol.

Sept 7 is when she got the suspision of DUI. It was probably pleaded down and that's why it's not regular DUI. Maybe she refused a field sobriety test which would've gotten an automatic license suspension.
The 1/15 was just a regular traffic stop.

The thing so many people " defending " her are missing is that yeah it is possible to commit a crime like this and only serve a few hours/days but that doesnt mean you have to.
She could be serving the whole 90 days acording to the law.
Also all we hear from her camp is that this shouldnt be this and this shouldnt be that but not once have I heard anybody fully admit that what she did was wrong.
There are 2 things I am confused about.
They keep saying that where she's being held is minimum security so how crowded is that part of the prison that she has to be released ?
Its not like they are making room for the gang-bangers. Violent criminals wouldnt be held in that prison so unless there's a run on non-violent parole breakers lets schedule these sentences so that we can accomodate all of them.
Also I dont understand how legally they can file a habeus corpus petition.
She's not being tried for a new crime. What can be appealed ? Shouldnt only a legal action be appealed ? What the Sheriff did wasn't judicial s how can it face an appeal ? If anything the prosecution should've been allowed to appeal her early release.

She wasn't convicted of anything on 1/15. So why was her license suspended?
45 days for this cluster is just stupid. I think 2 weeks would have probably been enough to teach her a lesson.
But according to prosecutors, Hilton violated at least three terms of her probation. First, she failed to enroll in an alcohol education course within 21 days of her sentencing.
Second, she had several traffic violations after receiving probation. On February 27, 2007, she was stopped by L.A. Sheriff Deputies for driving “a new Bentley” at 70 m.p.h. in a 35 m.p.h. zone “in darkness without her headlights on,” and without a valid driver’s license. Hilton’s license had been suspended by California&rsquos; Department of Motor Vehicles in November 2006 for having an "Excessive Blood Alcohol Level.”
Finally, prosecutors argued, Hilton failed to "obey all laws and orders of the Court," another condition of her probation.
On May 4, 2007, a judge sentenced Hilton to 45 days in jail for violating the terms of her probation.

Just like if you get pulled over and refuse to take a breatalyzer you automatically lose your license for a year regardless.
Again at your trial if the stop proved to be illegal or you were found not guilty for some reason you'd get the license back.
People don't realize that even a speeding ticket is in a way an arrest.
The ticket is given in lieu of actually locking you up and you have 2 choices : plead guilty and pay the fine or come to court and claim your innocense.

Every reality show has the heel. If everyone was nice then Real World or Survivor would never have made an impact. Couple of stats to support my original point that she got jobbed:
"The Los Angeles Times analysed two million jail releases and identified 1,500 cases since July 2002 that involved defendants arrested for drink driving and then sentenced to jail after violating their probation by driving without a licence.
Around 60 per cent left jail after four days. But Hilton was last week ordered to serve the full 23 days of her sentence, meaning she will end up doing more time than 80 per cent of others in similar situations.
According to the Los Angeles Times' analysis of jail records, before 2002, when an early-release programme to ease overcrowding was launched, inmates with cases similar to Hilton's were sentenced to terms of around 23 days and actually served 20 days.
After the programme began, the average term was cut to around 14 days, with inmates actually serving an average of four days. So Hilton's early release last Friday was not that unusual.
"Twenty-three days would be considerably more than the average person given her sentence would actually serve," Stan Goldman, a criminal law professor at Loyola Law School, told the Los Angeles Times.

I bet most of the people that did get jail time after they violated parole got that time the first offense after the probabtion.

This is why I don't often use the L.A. Times - while it sometimes does good investigative reporting, it's hit and miss overall, with quite a bit of bad journalism going in it. This is an example of bad journalism.
The comparison of her case to the "1,500 cases since July 2002 that involved defendants arrested for drink driving and then sentenced to jail after violating their probation by driving without a licence" is invalid because she was cited for driving without a license AND THEN sentenced to the 45 days when she was cited for driving double the speed limit at night with no headlights. She also didn't sign up for the court-ordered DUI classes. That's three violations of her parole - one of them a serious infraction on its own.
They also mention the fact that they narrowed their test sample to people who were released because of the overcrowding early-release program. She's not in the general population - she's in the special section for celebrities and other special cases. If that section of the prison doesn't have a problem with overcrowding then it wouldn't be necessary to apply the early release program to her - and the comparison is invalid on those grounds as well.
Now I'm wondering what's going on with the mainstream media. First the International Herald Tribune, (The New York Times), leaves the 70mph violation out of their timeline, and now the L.A. Times leaves it out of their story. But FindLaw has it in full detail, and they're lawyers with the full records. Something's fishy in the reporting of this story. Either FIndLaw is wrong or the LAT and NYT are wrong. A five second Yahoo search hits a February USA Today story about the 70mp-no headlights citation, but a Yahoo News search gets no mentions of the headlights in current stories. Something stinks here and it's coming from the press and not just her Herpe-Slurpie.
