Okay so I have a lease for my apartment and it is not over until April 30, 2008.
Here are the problems I have encountered as of late:
Infestation of Springtails and Millipedes (exterminator came, they went away for a little while and are back again.)
The bathtub/shower leaks on the bottom and has water stored up underneath the tub, i just noticed it today as the bathmat got drenched with me not in the shower. Not sure why I never noticed before but I am assuming the water wasn't built up enough to come out. I am also assuming this water is the reason for the bugs.
Infestation of some kind of weird beetles I have never seen before, these are brand new and just started this morning.
All the baseboards along the walls are not flush with the floor and things can easily sneak through them, they have known about that problem and stated they will not fix it.
Those are the MAJOR complaints, there are some small ones but nothing too drastic.
Can anyone just give me some ideas?

I did, but NJ has quite different real estate law then other states, for example both parties need Lawyers when purchasing a house, tenant pays for real estate broker instead of landlord, stupid things like that. So I am not familiar with all of NJ real estate law.
I cannot sublet the place per the Lease.
I could claim constructive eviction but not sure I want to go through all of that.
I also do not really feel like going to court over security deposit.

Take pictures of the problem with dates, etc. Maybe even see if you can get a free consultation from an exterminator, etc. to see what the problem is, and provide a written estimate to fix problem.

Yea I have pictures of the new bugs that have popped up since the exterminator was there (and pics of the old ones as well). I took a picture of the tub leaking but kind of hard to get a pic of water on the floor it didnt come out great.

Find any problems you can and start reporting them to whatever city agency you report that stuff too. Anything, even small things. Make it known you want out of your lease, and make it potentially more expensive for the owner to keep you around, and they will probably let you out of it. Here (http://www.washingtoncitypaper.com/display.php?id=1958) is a recent DC City Paper article about tenants abusing DC laws to take advantage of owners. I know the laws in New Jersey are different, but there might be some good ideas in there.

Is that what the lease says? I find it hard to believe that you are forbidden from doing that, but who knows.

I reviewed the lease and it states that landlord will handle all pest control situations.

Okay, but I guess the question is what does "handle" mean (assuming that's the exact language)? It probably means that you can't hire someone to fix it or fix it yourself, but does it cover speaking to someone about it to gather information?
It may make sense to talk to an NJ lawyer for a little bit about this. He or she will be able to give you some quick info.

find a new tennant to take your place, and then tell the landlord. they will leave a new security deposit and take the place the day after you leave, so there is no lapse in the lease.

as a matter of your safety, stuff steel wool in the void of the base board and floor and then neatly put silicone (caulkling) over it. nothing should get thru. as for the consult, you are allowed to have anyone visit your home and advise you as to what they see is wrong as long as they are a professional. hope that helps.

That landlord wont fix the baseboard problem as they state it will be to expensive and every apartment there has that problem.
The bugs, they did get the exterminator there even though it took them 2 weeks to get them there, not sure if it was there fault or the exterminator being booked up.
I just told them about the tub about 20 minutes ago, as I just realized it today and the office doesn't open till 9:30, they said they will go check it out, so I will find out more about that later today.
Yea i have to reread the lease tonight and find out about all problems.

you can try craigslist. if it is that bad, you can just leave and lost the security deposit. i know it sucks, but another year of that might be worth the 1200 or whatever you left for security.

also the lease for anyone interested is only a 1 page front and back crappy document from like the 70s that they have never updated so alot of stuff is not mentioned in the lease.

That is actually what I am thinking of doing, telling them to keep the deposit and just leave. I think its like $1,375.

the bugs stop in the winter, so if you can last until haloween you will be OK. as for the water, the person underneath you will eventually start to complain when their ceiling falls in.
once you tell them you contacted a lawyer, they will be there the next day

yes! read the lease over. Regardless if they cant afford a problem, they need to fix it. Thats not your problem if they cannot meet the expectations of a living space.

I am on the first floor so no one under me, besides a basement, which does house all the electrical for the entire building so maybe it will leak so much and fry everything.
Hopefully they fix the water thing today, cause who knows how long it has been building up for. The side of the tub that is on the outside, you can actually push in and water just flows out from it. I dont think you are supposed to be able to push the sides in, but this thing you can.

At the very least, if they can't fix it, you may be able to pay less rent, because you're not getting what you paid for. I can't say for certain under NJ law, but a NJ lawyer should know for certain.

Before I'd get any lawyer involved, I'd first talk to the landlord, and just tell him with the conditions that are in the apartment, you're not sure you can continue living there.
See what options he presents to you first.
But as previously said, document EVERYTHING.

I have no clue what previously happened on this board, as I was not visiting the board at that time. But as a practicing attorney, I've known since my law school days, that I have to be very careful about how I provide legal advice, and to be completely transparent in situations where I cannot provide legal advice. This is one such case.
And the only advice I can give is for Phish to speak to an attorney who is familiar with NJ real estate law.

He also said if they have a list of people who want to get into the complex it will be easier for them to let me go without causing a hissy fit as they can get someone else in ASAP.
He basically said talk to them about leaving and send them a certified letter with all the problems that have not been fixed.

i called my landlord to ask a question for you. they said with proper notice, if they can find someone to move in before you lease date end, you can leave early and get your security back. you only loose the security if you just leave, if they find someone else who can move in sept. 1st or whatever, then you can leave like a normal lease ending.

Yea I think most landlords would honor that. I might just call them up tomorrow to discuss with them. I want to see if they actually do fix the tub today, or if the deny anything is wrong.

This is probably the best advice. They're only likely to fight you if there isn't demand for the building. If they think they can get someone in there without losing any rent, they'll let you go before dealing with a fight over repairs.
Sometimes more detailed leases provide a method for breaking the lease, but I doubt there's anything like that in a two page lease. I'd also forget about constructive eviction as a viable option, just from my law school property class I remember it's a pretty high barrier and you need to give the landlord time to refuse to make the repairs.

I live on the bottom floor apartment in VA. We moved in during the winter, so there were no bugs. Once the warmer weather came in, we had elephant beetles, junebugs, millipedes, centipedes, wolf spiders, bee's and 'unidentifiable' coming it. Our complex has ORKIN come every 2 weeks to spray. That being told to us 3 times and bugs still coming in, we went out, bought our own bug crap and sprayer (pet safe for indoors), and had a field day one night. Everything died. Things were coming out of the vinyl siding dying. There has been no bugs in our apartment for 3 months. It cost us $60 to do, but we didn't have to leave. Apartment have contract agreements with insect control people. They water their shit down (as we learned). I pay $1535 a month rent. there should be no bugs. Even so, they would not move us into a 2nd floor apartment without charging us a $500 move fee plus higher rent ($1640 to go up a floor, dicks). Apartments are just like this. Even the luxery crap i live in. My last place was a 2 year old building with a severe silverfish infestation.ugh. Once they have your signature, they really could give a crap.

So i went home and met with the property manager because he said he could not find a leak in the tub.
I showed him and he said the entire tub/shower needed to be regrouted(sp?) and he cant get to it till next weekend as he has to get 2 apartments ready for move ins.
He said what it is, is there is an old cast iron tub underneath and then they put fiberglass around it, but the person who did this back in 2006 did a crappy job and the grout and caulking is coming off and the tub can actually move, so yea needs to be fixed.
He said the stale water under the tub if there is a lot there could be causing the spring tails and millipedes.

Did you tell him 'fuck that, you deal with me now'? Just kidding, that would be great if the tub and bugs are related, but I wouldn't let them off the hook just because they agreed to fix the tub.

Yea they aren't off the hook. I am just going to take it one step at a time, document everything wrong and the time it took to fix everything.
I did re-read the lease and the job transfer rider, what they say is if I leave early even with the apartment being re-rented to someone else or because of a job transfer I have to forfeit my security deposit, but I am not sure if that is legal, so I have to look into that.

mahwah may be luxurious but my apartment complex sucks. Visitors seem to like it, but I hate it.

the work itself is very easy to do. will they let you do it yourself as a temp. fix? or do you have to wait for them? also, you want an exterminator to come in after the tub is fixed and the base board work is not hard to do at all.
the problem with the tub is very common.

There are no more springtails and when they were there they were confined to kitchen sink and I threw out every dish and platter and tubberware i had in the kitchen and bought all new stuff.

There were another 200 Spring tails in my kitchen when i woke up, about 100 in the sink and another 100 on the stove and in the oven.
I tried to take pictures but the suckers are so small and my camera is not amazing so its kind of hard to capture these little things in pics.
They told me the exterminator came and sprayed, but thats the problem everything I have read about these guys, spraying does not kill them you need to find the nest and remove it and then close all holes they are coming through, which I dont think they have done.
So now I am stuck calling them again and them being complete bitches to me about it.

They told me the exterminator came and sprayed, but thats the problem everything I have read about these guys, spraying does not kill them you need to find the nest and remove it and then close all holes they are coming through, which I dont think they have done.
So now I am stuck calling them again and them being complete bitches to me about it.
switch your camera to Macro Mode or Digital Macro Mode. it is used to take really close up pics of small things. mostly all digital cameras have it. you just have to hold it about 5 inches from what you are trying to take pics of.

switch your camera to Macro Mode or Digital Macro Mode. it is used to take really close up pics of small things. mostly all digital cameras have it. you just have to hold it about 5 inches from what you are trying to take pics of.
damnit i wish i knew that. I had already killed them when I tried this morning.

just spoke to LL this is what they told me:
They said that the exterminator did spray and put down some special sticky thing in the ground and like the foundation of the building that kills spring tails and the LL said he believes the heavy rain last night caused them all to come out. Told me to monitor it and keep them apprised of the situation.

working from home and living in an apt, I am privey to what the exterminator in my apt does. he comes in, with the property manager waiting by the door. he spends all of 45 seconds (no exageration) spraying the baseboards in about 1/2 of the room in my apartment. he sprays the wall in my living room that does not touch the outside, he sprays 1/4 the walls in my office, 1/4 the walls in my bedroom, i remind him to spray the bathroom, no kitchen, no dining room. and my living room is 24 by 10, and he sprays 1 small wall.
so what I did is what was mentioned above. for like 30 bucks at home depot, i brought one of those sprayer kits and did it myself. it is kind of annoying that you have to take matters into your own hands, but i guess 30 bucks and an hour of time is worth it. it was bad in here before i did that. i am only on the 1st floor, and right near a wooded area, so we get creatures making their way in here. not infestations, but one every few days.
self spraying was amazing. i sprayed inside and out. it says it last for a year or 6 months, but I do it in 1/2 the amount of time they say.

yea that could, and whatever he sprayed might have been annoying them and made them leave the nest

I think I will follow your suggestion and get a sprayer kit from home depot friday after work and just go crazy.
Did you have to leave the apartment or cover anything up (i.e., kitchen stuff) when you did it?

no it is pretty harmless stuff, i think it is even pet safe and all that shit. it is not like a bug bomb or anything. you just pump, spray, and leave it. no smell or anything.
i mean i would not drop food in the area, pick it up and eat it, but other than that you should be safe. i will look for a link

Sweet thanks nick I will pick it up tomorrow. It doesn't say it kills spring tails but cant help them anymore lol. Doing it myself will just let me sleep better at night.

All the baseboards along the walls are not flush with the floor and things can easily sneak through them, they have known about that problem and stated they will not fix it.
This is not a problem.
Sometimes baseboards are installed "up" a half inch or so because the floor is not level or in order that carpet put down later doesn't make them look too small after the shoe molding goes in.
Behind the baseboard is a half inch of drywall that probably doesn't go to the floor and then the sole plate of the wall framing.
Are you afraid of 1/2 -inch wide snakes getting back there or something?
