Edit... OK. I think I get it. You must be listening to the replay.

If I'm not mistaken, the case Fez is talking about it really bad. I think he was actually 17 when they did it (and by "it", I think it was oral sex), and she wasn't drunk. Almost everyone involved in the case wants this kid out of jail, but the way the law is written there, they can't get him out.
