No, I would argue that the key interpretation is not the 22nd Amendment, but the 12th. Specifically, the word "ineligible" in the 12th Amendment. "Ineligible" in the 12th Amendment means not eligible to be elected President. Thus, because of the 22nd Amendment, Clinton is ineligible to become President, and thus, the 12th prohibits him.

I also argue that this interpretation makes sense in light of the intent of the 22nd Amendment, which was to limit our Presidents to two terms. Well, which interpretation of the Constitution support this intent?

Surely, Bill couldn't run for President now because of the 22nd Amendment right? Congress' intent couldn't really have been to say well, you can't be elected to President anymore, but you can be elected vice-president, and then get in through the back door.

I don't think so, given my "intent" argument. My interpretation does not frustrate the intent of the 22nd Amendment (stopping Presidents from serving more than two terms). It's a basic tenet of contract, statute, and constitution interpretation that you cannot interpret one portion of a contract/legislation/constitution in such a way to frustrate other portions of the contract, etc.

Rather, an interpretation that is consistent with the meaning/intent of other portions of the constitution/contract will be upheld over one that creates an inconsistency.

Well, as a lawyer who has studied constitutional law, I disagree with your position.

As for the other positions you mention, the chances of any of those persons becoming President are much rarer than a VP becoming President. Look at how many times a VP has become President versus any of those other positions. Also, the 12th Amendment only addresses the Vice President. It does not address the other positions you mention.

Moreover, Congress' intent was to prevent another FDR, yes. And interpreting the Constitution my way stops that, because my interpretation stops a President from serving more than two terms. You're way allows a President to serve more than two terms by running for Vice President, and then having the President resign, etc.

The answer is: He can. The 12th Amendment states that anybody who is eligible for the presidency under Article II of the Constitution (a natural-born citizen age 35 or older) is eligible for the vice presidency. Clinton is a natural-born citizen over 35, so he qualifies. The putative roadblock to a Clinton vice presidency--the 22nd Amendment--doesn't apply. This hastily worded and passed amendment, designed to block another multi-multi-term presidency such as FDR's, only bars the election of a president to more than two terms in that office. It doesn't prevent a two-term president from running for the vice presidency.

If you look at the flow chart of the argument, it's he fails 12th because of 22nd.

I don't see where my argument goes back to 12, and then back to 22nd.

Well, as a lawyer who has studied constitutional law, I disagree with your position.

As for the other positions you mention, the chances of any of those persons becoming President are much rarer than a VP becoming President. Look at how many times a VP has become President versus any of those other positions. Also, the 12th Amendment only addresses the Vice President. It does not address the other positions you mention.

Moreover, Congress' intent was to prevent another FDR, yes. And interpreting the Constitution my way stops that, because my interpretation stops a President from serving more than two terms. You're way allows a President to serve more than two terms by running for Vice President, and then having the President resign, etc.

I agree, but does the Constitution preclude Mr.Clinton getting blow jobs in the White House,should his wife ge elected ?

It's an interpretation of the word "ineligible" in the 12th Amendment. I'm saying it means someone who can be elected to the Presidency under the Constitution. Just as a further note. Yes, there are other ways to enter the office of Vice-President and President than election. But the 12th Amendment only deals with election of such persons. In that frame, it says that a person ineligible for President is ineligbile for Vice-President. Since the whole amendment deals with election of persons into such offices (not assumption through death, resignation, etc.), it makes sense that the ineligible language deals with election inelegibility.
