No, I would argue that the key interpretation is not the 22nd Amendment, but the 12th. Specifically, the word "ineligible" in the 12th Amendment. "Ineligible" in the 12th Amendment means not eligible to be elected President. Thus, because of the 22nd Amendment, Clinton is ineligible to become President, and thus, the 12th prohibits him.

I also argue that this interpretation makes sense in light of the intent of the 22nd Amendment, which was to limit our Presidents to two terms. Well, which interpretation of the Constitution support this intent?

Surely, Bill couldn't run for President now because of the 22nd Amendment right? Congress' intent couldn't really have been to say well, you can't be elected to President anymore, but you can be elected vice-president, and then get in through the back door.

I don't think so, given my "intent" argument. My interpretation does not frustrate the intent of the 22nd Amendment (stopping Presidents from serving more than two terms). It's a basic tenet of contract, statute, and constitution interpretation that you cannot interpret one portion of a contract/legislation/constitution in such a way to frustrate other portions of the contract, etc.

Rather, an interpretation that is consistent with the meaning/intent of other portions of the constitution/contract will be upheld over one that creates an inconsistency.

As for the other positions you mention, the chances of any of those persons becoming President are much rarer than a VP becoming President. The 12th Amendment states that anybody who is eligible for the presidency under Article II of the Constitution (a natural-born citizen age 35 or older) is eligible for the vice presidency. It's an interpretation of the word "ineligible" in the 12th Amendment. I'm saying it means someone who can be elected to the Presidency under the Constitution. Because the 22nd blocks an election of someone who has already served two terms, he renders him ineligible. And that fits with the rest of the 12th Amendment which is all about how a President and Vice President are elected to office.

It's not a presupposition, nor circular logic. It's what courts do all the time in interpreting words in the Constitution, statutes, etc.

So again, I say that he fails the 12th amendment because of the restrictions of the 22nd. It stills goes from 12 to 22, and ends there.

Just as a further note. Yes, there are other ways to enter the office of Vice-President and President than election. But the 12th Amendment only deals with election of such persons. In that frame, it says that a person ineligible for President is ineligbile for Vice-President. Since the whole amendment deals with election of persons into such offices (not assumption through death, resignation, etc.), it makes sense that the ineligible language deals with election inelegibility.
