I took a Crim Justice course way back with a similar scenario; bunch of really drunk guys take a really drunk lady to a hotel and have their way. Seems she had died en route to hotel, so the defense was, essentially, we didnt know, we were all shitfaced, so: you cant rape a corpse. There are other crimes, but sex with a dead body, they argued, wasn't rape.
Probably got some/most of that wrong, but its a scenario you dont forget.

I believe this is correct.
To do a similar occurence but in another context. Let's say you went to someone's house to kill that person, walked in to where they were sleeping and shot the person. However, the person died hours before of a heart attack. So you couldn't be charged with murder.

She had stories that had us in tears, regularly. She'd warn us, and of course we always wanted to hear the story, and we soon regretted our choices. People would have to leave the room, people got ill...
She = she worked with lady victims, and had an extensive knowledge of what men can do to women; emotionally and physically. Listening to what she has had to deal with, some would say our species is doomed. If people can do X, Y, and/or Z to another human being, we're fucked.
One thing I learned: No matter how strange the scenario you can dream up; there's a real court case out there that blows it away.

I worked in the New York County District Attorney's office for a year, and have a very close friend (ex-girlfriend) who worked sex crmes of a little while. Based on that experience, and stories from from friend, I can definitely agree.
With regard to whether we're doomed as a species, I guess my thoughts is that we used to be worse. Reading stories about what NYC was like in the 1800's with the prevalence of child prostitutes, violence, etc. really puts stuff like that in perspective.
We're never going to get rid of that side fully, but we could be a lot worse. And it could be happening a lot more than it does.

You shoot your gun as he passes by the window, he is still alive when the bullet hits him, and dies of the wound before being splattered on the pavement. He was going to die anyway, by his own hand no less, but you are the one who killed him.
