So not only are the stresses of a baby anyday killing me....

Let's add some more shall we?

I got home to a note on the door saying "NO PETS WILL BE ALLOWED IN THE BUILDING EFFECTIVE... NOW"

So my lil strummy needs to go. This could not come at a worse time. I love this puppers like she is my kid. It would be impossible to leave her.... just flat out not friggin happening.

I guess we have to move.

Couple this with a summons I got about an old debt that my ex had made. 10,000 fucking dollars. I just can't catch a fucking break.

Man alive... I can barely breathe.

Isn't your dog a small dog? You could easily hide it from the landlord, as it happens all the time in the buildings I've been living in.

Also, if you have a doctor as a friend, have them write you a note stating that the dog is needed to help you cope with depression. Two people in my building now (one actually transfered from the building my wife manages, which also doesn't allow dogs but the person was allowed to have their small dog because of the doctor) have that going for them, and the building has to let them keep the dog (I'm assuming its a law).

Good luck keeping your dog. Having to give away a pet is one of the worst feelings.

So I guess he is choosing to enforce it now.

well, in the interest of full disclosure, i am not overly familiar with new york landlord/tenant law, but my hunch tells me that your dog should be allowed to stay until the end of your lease.....the contract (i.e. the lease) you entered into presumably allowed pets at the time you entered into it.....as such, the landlord should be legally bound to oblige to the terms thereof. The basic legal principle is that you cant change the terms of a contract after it has been executed. Again, i am not 100% sure, but i think if you consult (for free) with an attorney in your area, he/she should be able to assist you.

As for the $10k debt, well, that is something that could be settled for cents on the dollar....when a collection agency buys the debt, they usually do so at 30% of the amount, meaning that you could negotiate it down to at least 35% and have it discharged.

good luck....u sure as shit dont need this stress this close to baby's birth day.

That's really shitty. I'm sure you'll be able to find someone to take care of your dog for a little while, while you get things straightened out. It might actually help a bit, to not have Strummer around for the first couple of weeks after your baby is born. The first few weeks can be pretty damn hectic.

well, i would argue that, despite the rule against pets in the lease, the landlord waived this provision, or at the least acquiesced to the presence of pets, and based on said waiver, you took on the responsibilty of pet ownership. But for your reliance on the landlords tacit acceptance of pet ownership, you brought a pet into the apartment. As such, Strummer should be grandfathered in, as it were, and the new enforcement of the rule should only apply to new tenants.....

I know how you feel. I'd be a wreck without my Buddy. It will work out, though. You guys have a HUGE network of people who care about you and are willing to help. I can't, of course, but I'm sure a lot of people up there will jump at the chance to help.

underdog, i commend you on your legal research skills.....as i said earlier, the landlord's acquiescence could be deemed a waiver, which this statute seems to confirm.

I highly recomen Woodlawn in the Bronx..They call the nieghborhood "Ireland's 33rd county". So basicly if you send Dave apartment shopping..All he'd have to do is ring about 3 doorbells max,before that red hair and last name would score a beautyful 3br in a private house for about 50% of what you're area costs..I highly recomend the nieghborhood..Btw it's under an hour to midtown..

All it takes is a few filed complaints by neighbors about your dog barking to get you evicted.

Casey, hide the dog until your landlord personally confronts you. I bet more people in your building are going to do it as well. The camera thing is fucking insane, maybe you can train stummer to "crate" or whatever that word is to make dogs piss and shit on a newspaper.

As far as the debit card thing goes, I'm sorry and that sucks. Dave is going to have to eat like 100 pieces of shit on different O&A shows to cover that bill. Honestly though, I hope everything works out.

See I believe the opposite, if you have a dog it needs to be by the baby. How can you take a dog out of his territory then bring it back with a new little person living in there. The dog needs to bond with the baby also. When my friend had a baby her husband took 1 of the babies blankets home from the hospital so the dog would have the scent of the new baby. Later on down the road you will see what a bond the dog has with the baby if you start it off right from the begining.

My sweet god that sucks. There is no way in hell I would ever get rid of my dog for a filthy landlord. If you say there are tons of tenants in your building who have pets, I'm sure they are enraged and are going to rally against the landlord. I don't think each and every tenant in your building is going to listen to that ridiculous rule and get rid of their pet, or break lease and move out now. Find out if you can from others in your building what they are doing to fight back.

Don't hide anything from your landlord. If you see him talk to him , say that Strummer was here before his decree lease or not the landlord knew he was here so your keeping him. If the discussion gets heated walk away if he persists call the cops so theres a record that he is threatening you. Then tell the landlord that you will no longer speak to him face to face only through attorneys.

When I lived in Brooklyn I lived in an illegial live work space with a landlord that wanted to be Tony Soprano so bad. All he turned out to be was a paper tiger. The laws in NYC favor tenats landlords know this so they try to bully tenants don't let him.
