last week on drug charges. i got possession and transporting weed. i'm 29 and this is my first run in with the boys in blue so i'm not really sure how the process goes.

i got nabbed with a half ounce of kind bud (split in to two bags that were quarter ounces ea) and a pipe and whatever. i think the two carry a maximum of a fine and possibly loss of liscence. now assuming the two bags thing was left out and i'm just looking at the two charges would i be better off pleading guilty to the two? can i cut a deal? plead guilty to possession if they drop the transporting charge? how would i go about this? anyone?

Get a lawyer. See if your state has some kind of probation for first time offenders. You plead guilty and pay a fine, but after a six month or year probation period, the charges are dropped. Then you can have your arrest expunged.

Of course this all matters on the amount you have and your local laws.

i can't really afford a lawyer so thats 90% of my problem.

long story short, i fucked up and i'm willing to walk the plank, i'm just trying to minimize the penalty.

talk to the da, first offense you may get lucky and get to plead to a far lesser charge.

That was always my reason too, but you have to find a way.
At least go talk to one and see what they will work out with you.

I was just denied a job waaaayyyy below my qualifications because of a misdemeanor charge from over ten years ago. That shit stays with you, obviously.
At the time, my pal faced the same charges and spent 500 on a lawyer. He has nothing on his record.
Think of it as an investment.

i got out of my car with a friend, i was walking in to a bar and as i shut my car door i heard a voice "hey, where you going? come back here". it was in my pocket and i had no time to do anything. i don't even know where he came from. i don't know when the last time you ate weed was, but i don't think i could have swallowed a half ounce without something to drink.

Find out if your state has intervention program or diversion program for first time offenders. It worked for me. Downside: drug tests and it can cost more than the fine might be. Upside: clean record.

I HIGHLY suggest you go talk to a Lawyer. You don't have to hire a lawyer, just use them for guidance.

Check and see if your state has a "First Time Offender" program that will allow you to pay fines, go to rehab, maybe some community service. Not sure about your state, but Pennsylvania has a Accelarated Rehabilitation program, which is for first time offenders. You should look into it.

Contact the arresting officer and see if he or she will work with you on the issue.

You want the City Attorney, etc. to agree to a Holmes Act sentencing Plea. If this is really your first felony encounter then you are eligible as the separate charges will all be considered part of a 'crime spree'. Usually if you just cop to buying yourself two quarters, (don't admit it if you bagged it), and getting caught they will only want a lot of fine money, probation, and you can't get in more trouble for it to go off your record something like 6 months after you finish your paper.

i dunno a whole lot but i do know my brother got the book one time because he chose to represent himself...basically the DA said he should learn to use the court appointed at the bare minimum....

although u most likely wont be going to jail...even if u do it wont be for long....
if u do anything bad in jail i know u should plead guilty even if u are completely innocent...once ur in jail there is no such thing as justice...

I do do illegal things, but am smart enough to know I need my lawyers card in my wallet, and I always have money for emergencies, including lawyers and fines.

you need a lawyer, even if you have to beg and borrow money for it, without a lawyer you could do some jail time.

I'm not ashamed to admit, I had 3 court appointed lawyers in 3 different jurisdictions, all at once in 1999. They all did a great job. When you appear for your first court appearance, the judge will ask you if you need one. You'll have to prove you're illegible, but that's pretty easy. One of my charges was for cocaine, and without a lawyer I would have been royally FUCKED. With weed, you'll have it a lot easier, but you still need the lawyer.

as an attorney (and pot smoker) i feel your pain. My best advice is to get yourself an attorney. I have had to take on pro bono cases for indigent defendants, so you may luck out. Even a PD is much better than representing yourself- no question.

Your state may offer some sort of PTI (pre trial intervention) wherein the charges end up being dismissed provided you undergo some drug counseling and/or community service. Or the transporting charge may be merged into the possession charge as part of a deal.

Bottom line, get an attorney, and be smarter about smokin the ill na-na.

I got raided about 1 1/2 years ago for growing, and they nabbed about ten lbs.

My roomie took the rap because he had no priors, ( and I was conveniently dying in the hospital when they raided), and he ended up with a years paper, and we had to pay a lawyer 5 k and the fines are @ 5 k.

We only offered a few things for defense: One - I have a medical condition that pot helps ease the pain tremendously, and it is of course very well documented including the phone call the cops made to the emergency room that morning where the presiding physician told the cops I was losing vitals as they spoke. Two - I wrote the Judge a letter telling him we bagged the weed to measure it out for my treatment so we knew how much I use and how much we would need later.

The irony here is that in November Michigan votes on medical marijuana, and three quarters support it in the polls - looks to be a certainty to pass, and come Jan. 1 2009 I can resume my grow room for personal use with my Doctors prescription.

The worst part of the raid is that I can no longer ever trust the authorities to do the right thing. The damage incurred here was far beyond the necessary trashing required to search, and the son of a bitches even left two doors wide open when they took my roomie in for the arrest. I don't care if I am dying, or I witness a murder; I will never call them for anything, and I will never help them no matter the circumstances. 6 cops played juvenile delinquent in my house to the point that I am certain these turds have no conscious when gathered together and so it was with some morbid glee that I read about one of their deaths in a self-inflicted traffic accident a few weeks later. The moron had a drunk in the back, and pulled across the freeway without looking. The drunk is suing for damges.

As for smoking only at home - that's the ticket imho. I use my garage as a smoke room and nobody has to smell it or worry about catching a contact high.

I agree to get a lawyer asap. You can sit down with them, and discuss what your options are. After they give you the price, tell them that you are going to think about it.

What's interesting is that if your crime rap was reported in the paper, you should receive tons of Lawyer letters in the mail offering help.

Nothing wrong with asking for advice from friends.

***UPDATE***

i took everyone's advise and hired a lawyer, 6 months, a couple G's, and an arrest for a bench warrant later there was no finding, goes on file for one year. no fines, nothing. if i get caught again within the next year it comes back.
