kbk, would a passenger be charged if he snapped the neck of a jerk lighting his shoes on fire aboard a plane?

if they would of killed that guy, would they do time?

i doubt a jury in the united states would find anyone guilty

A person may defend himself and others against a person threatening them with physical harm. The only question is how far this defense can go.

They would not get charged so long as the amount of force they used (specifically deadly) was warranted given the circumstance.

In the situation you described I cannot imagine any charge being brought. Rather the person would be hailed as a hero for saving the lives of the passangers and those on the ground.

If the guy was already subdued however, and no longer a threat, and then someone broke his neck, that guy would be charged. (Personally, I think the neck snapper should get a medal).

The tv show "CSI" had a very similar story last night. I'm pretty sure that it was made before 9/11, and obviously before this week's shoe bomber.

Big lug is acting obnoxiously on a plane, pestering the flight attendants, kicking the seat in front of him, etc.

Finally he freaks out and starts pounding on the cockpit door. About 5 passengers (who are already pissed at his previous behavior) try to restrain him. The guy then tries to open the emergency door of the plane.

The passengers finally get him on the ground subdued, but they proceed to beat the living crap out of him, finally killing him.

Turns out the guy is suffering from encephalitis (brain swelling), and his previous obnoxious behaviors could have been explained away by that. And since he was already subdued before the other passengers proceeded to beat him to death, technically they are guilty of murder. However, if the guy had succeeded in breaking into the cockpit or opening the emergency door, he would have killed them all. Cops declined to press charges because they were acting mainly in self-defense, even though they technically went too far.

This was actually based on a true story of a very similar incident I saw on Dateline, but that guy survived. No consolation to the people on his plane that he almost crashed, however.

Before 9/11, I think there might have been discussion about the hypothetical neck-snapper maybe having gone too far, but with the status of the world right now, it's open season on plane assholes, and rightly so.

Qatari Diplomat In Custody After Attempting to 'Light Up' His Shoes

Federal air marshals subdued a man who authorities say attempted to "light his shoes on fire" on a United flight from Washington Reagan to Denver Wednesday night, federal law enforcement officials told ABC News.

Authorities say an explosive team is on the way to the airport, and that while the presence of explosives has not yet been confirmed, they believe it was an attempted "shoe bomb."

The suspect was identified by authorities as a diplomat in the Qatar embassy in Washington, Mohammed al Modadi. The FBI said the man had full diplomat immunity as the 3rd secretary and vice-consul.

Authorities said two jet fighters were scrambled from Buckley Air Force Base to accompany United flight 663, a Boeing 757, as it flew the final 40 miles to Denver where it landed safely.

Authorities said the man, identified as from Qatar, was restrained by the air marshals who were on the flight.

The United jet was reportedly being directed to a remote location at the Denver airport.

A spokesman for the FBI in Denver declined to comment.
