All knowing Oracle, I ask for your guidance. Mrs. Snot got a ticket for doing 82mph (in a 55mph) zone by a NYS Trooper. We pleaded not guilty in hopes of putting off the insurance hit. We just received a court date (in Suffolk Co.) and it is when we'll be out of state on vacation.
The letter states that if she fails to show, her license will be suspended. The letter also gives us the option to change our plea online, and pay the $160. fine. Is there a way (without paying a lawyer) to change the court date? It's her first offense, but the points will be a pain in the ass. Returning for the court date is not an option. Should we just change the plea and pay the fine? Guide me Oracle.........thanks.

I'm leaning in that direction but, isn't there a chance to plea it down? What if the Trooper has vacation plans and can't make it? I had a ticket dismissed because the cop didn't show.

Call the court and tell them you'll be on vacation on that court date...They will most likely be able to reschedule you.

If they won't change it and you don't want to deal with the insurance hit, the other option is hiring a lawyer to represent you.

As a fake lawyer, my fake law degree and fake bar only extend to the great state of New Jersey, so I'm not sure how pleading down in NYS, especially with a state trooper works.
You may want to research further if it's possible.

Reschedule it and definitely go to the court date.
When I went for my recent tickets, they had the judge call you, and he'd immediately send you to the DA to plea it down. Both of mine got dropped. Saved $300. Also Suffolk County. I saw several people with speeding tickets get it reduced to seat belt violations.

lol. yeah right. OH im going on vacation. please tend to MY needs. Here in Illinois they would laugh at you for that and tell you find the appropriate paper work.
There is a form that you can petition in the court to get an extension. most of the time its to gather more evidence if your case is correct.
you are lucky it wasnt a wreckless. but if a cop gets you going 82mph your usually guilty so why are you fighting?

That's how it works here. You don't even have to bargain, really.
Everyone enters courtroom, waits for Judge.
Judge calls your name and says ok, talk to the DA.
Judge leaves.
Talk to DA for 2 minutes, get ticket reduced.
Judge calls you again, asks you to pay lesser fine.
Wash, rinse, repeat.
Mine weren't speeding tickets, I had expired registration and no proof of insurance (I did have insurance, just had the old card in my car). Both dropped. Also, this was Village Court, not County Court.

That's how it's done here in small little courts. In the end all they want is some cash from you. They really don't care about points, this that and the other thing. As long as you didn't do something asanine like 120mph in a 45, or make them chase you, you can usually always get your ticket reduced to something minor and pay a fee.

Couldnt be more wrong.
Fax the court a letter with a copy of flight/hotel etc itinerary....tell them that this was a pre planned vacation plan and that you plead are pleading not guilty and are waiving your first appearance. you "respectfully request a short adjournment". if its a recent ticket, and its only your first appearance, then they should grant you an adjournment.

Just wanted to let everybody know that while attempting to enter a plea online, we noticed an option that allows you to reschedule your hearing date. We're good until Sept.
I'm not surprised, but none of this was mentioned during two phone calls to DMV.

1. Send a letter to the court asking for a different date, they will accept it, state you will be ut of town on the date specified.
2. Call a lawyer. They will tell you is Suffok county is a guilty or not guilty county, or a county that accepts pleas.
Even if you dont retain a lawyer, if they accept plea bargins, go to court with $300 cash minimum, try for an 1110.a(fail to obey traffic control device), or see if they will do an expensive non moving violation.
82 in a 55 is a major ticket with alot of points. If the driver is not from NY see if the home state accepts points from another state,if not you can simply pay the fine. If they do you will want to fight, I think 82 in a 55 is a 6pt violation, which will give you a bad license.

Paying the fine is definitely the better option here. The law doesn't give a shit about your personal life or else we'd all be able to conveniently not attend jury duty when they tell us to.

showing up to court has worked 2 out of 3 times for me- officer didnt show up.
vacation - i just had to change my plans and now it looks like an even better vacation.
ranger HOPE's to open by fourth of july due to snow... and some ice still remains on lake. im shoot'n for the 14th
like how i just made it about me ? i stink !

I have delayed 99% of my court proceedings to get a better date. Most courts will change dates for silly reasons.
I always tell the court in a letter that I am out of town on Business. They never question it and never refuse to change the date.
