View Full Version : Did I lose this bet on a technicality?

Here's (another!) simple betting situation at my day job that went horribly awry.

Okay:
I have a coworker (Paul) and I think he's 39 years old.
A fellow coworker (Jay) thinks Paul is 40.

I'm sure that I'm right. Jay is sure that he's right.

We made a bet:
"Paul is 39 years old. Not 40." We made it interesting, settled on amount, and shook hands.

DONE.
How can we prove it? Well... there's a chance that, when asked, Paul will lie about his age. Valid point. So I said to Jay "when we see Paul, we'll ask him to show us his driver's license. And his license will prove that he's 39 years old."

Jay accepts this proposal.

We go to Paul's office and ask to see his license. He says "I don't have a license, but I have my birth certificate. Here... take a look at it."

His birth certificate states that he's 39 years old.

Jay feels that he shouldn't have to to pay because Paulie didn't produce a "license". And that "the bet was that his license would state Paul's age."

I say; the physical document is not important. The bet was about his AGE, and the license was just a common, simple, "legal", way of proving that. A birth certificate is, without question, a perfectly legal & acceptable way of proving one's age. Granted... it's less common. Not many people carry it around, so I didn't think to say the word "birth certificate".
Jay maintains that he shouldn't have to pay out. (even though Paulie is not 40.)

Thoughts.

You win, but who the hell walks around with their birth certificate?

Someone who is worried about the INS that's who.

The bet was on age, not on the type of proof.

Jay is a welcher.

Well if he lives in NYC, I can understand someone not having a license. If it's not practical to have a car in the city, why have a license.

My boss is in his mid 40s and doesn't have one. He lives in Queens. And buses it to Jersey.

I'd think it would be good to have one just in case you ever wanted to travel.

I agree totally, but I do know a few people who grew up in the city who never got a license.

I'm so glad tomorrow is pay-day.

PS:
He had a license for most of his life. Had some kinda trouble with some unpaid tix. Lives and works in NYC, never bothered to clear it up. Yada yada yoda.

I like where you're goin' with this but..... no go.
I'm using some of that money to buy new pickups for my Fender Pbass, and I'm giving Jay 40 bucks to install 'em.

I couldn't be happier.

Assuming the facts you provided about how the bet was reached are accurate, you win.

And even common sense wise, who would ever make a bet that someone's license would say they are 40 years old?

So.... perhaps I shouldn't tell you about the time I bet 500 bucks on "whether or not the keyboard player from Danger Danger did or did not have a weird growth on his upper lip back in 1989"?

That was a sweet payday too.
One day... I'll lose. Today was not that day.

I seriously don't think I have a problem though. For real real.

tell your friend not to make bets if he is going to be a dick and not pay up on bullshit like this.

You know who does those annoying things, addicts. You would say something like you drank 11 beers last night and they will say no and argue and then it comes out they drank 12 and they would say "well you said 11" I fucking hate stupid fake lawyer shit.
