From the Chicago Tribune:
A Chicago woman says she was mortified when a high school friend said he had spotted nude photos of her on a Web site, according to a lawsuit filed Wednesday. The woman instantly suspected her ex-boyfriend, who had taken the photos but promised -- even after their February 2006 breakup -- that he would keep them private, according to the lawsuit filed in Cook County Circuit Court. But the ex-boyfriend, Miles Marsh, secretly posted the photos on the site that encourages men to post nude photos of ex-girlfriends, according to the suit. The suit claims Marsh intentionally inflicted emotional distress on Jessica Voth and invaded her privacy by posting the photos online without her knowledge or consent. Voth says she was informed about the pictures by the classmate last November. The suit seeks unspecified compensatory and punitive damages.

I wouldn't be uncomfortable at all.
Even if you were you could email, text from a website, send a letter, leave a note, etc.

I probably would've told her. I know it would have hurt her feelings, but ignoring the problem might result her hearing the bad news from a much less sensitive person.
I don't know why anyone would give nude photos to someone you don't completely and totally trust.

Can't trust anyone. If you give your photos to a lover, be prepared for him or her to post them online when things go sour. People, especially jilted guys, are jerks.

not quite, you can own and use them for private use, but as soon as you publish them, especially for profit, it requires a model release/ consent form.

If this chick won this lawsuit, it would set a precedent for literally tens of thousands of similar lawsuits nationwide.
As I've said in the past, having or knowing where to find nude photos, sex tapes, etc. of people you know is pretty much the norm with people my age, because everyone records shit.
As far as whether she would win, probably not. She would have to proof that he took the photos in an invasion of privacy thing, which, even if he did, would be nearly impossible to prove now.
If the guy took the pictures, she allowed him to take them, or she gave them to him, they're his and he can do what he wants.
She can take solace in the fact that pretty much everyone has some floating around somewhere these days if you're under the age of 30.
I think I probably still have some of a few ex-girlfriends on the hard drive of my defunct laptop. Not for any particular reason...it just broke, and I've never really given a second thought to what's even on there. I can't imagine how many videos and photos are just sitting out there on old hard drives of people's just waiting to be rediscovered.
