Ron is right. This would be the end of exciting sports. Athletes know what they're getting into when they play the game. If someone is being really out of order, they should be sanctioned/fined/expelled/whatever, but how could you prove/disprove criminal intent with a fastball? At least in soccer, if you get a red card or something, you are suspended for a couple games.

Fez is kinda right on this one. There's got to be a line somewhere between "part of the game" and straight up assault.

foodcourtdruide

I think it's about extremes.

If a pitcher intentionally hits a guy in the back, fine. It's a part of the game.

However, if the batter hits someone intentionally with his bat, then he deserves to go to jail.

I agree, but I think Fez doesn't know enough about sports to say where the line should be drawn. If someone gets injured on a cross-check it seems ridiculous to throw the other guy in jail. However, if a player intentionally slices the goalies hand with his skate I think criminal charges should be considered.

I dont believe a word of the story Dave just told about baseball.

Also, they're ignoring a threshhold of whats acceptable and expected and what is not. I dont think it is ever accepted to intentionally try to injure someone.

Which is why you throw at ribs, because they can turn in and take it in the back and not get hurt.

The controlling theory, in civil suits, is assumption of risk. How an athlete assumes the risk of, e.g., a sports injury, and therefore cannot sue the "perp," yet may be a criminal victim of the same act is beyond me.

I agree that they are assuming a risk, however, if a hockey player uses his stick to strangle someone on the ice, it would be a criminal act, even if it was during a game.

Blowhard is incorrect. Being hit with a bat IS NOT THE NATURE OF THE SPORT OF BASEBALL.

hockey player uses his stick to strangle someone
Yup - That'd be a tough one to argue against; but only because that act, in fact, would never be within the scope of the athlete's assumption. That is, the "slippery slope" don't flow down that path IMHO.

yes, but thats NEVER happened. OBVIOUSLY, if you intentionally killed someone during a sporting event, then yes you're going to be brought up on charges of murder. we're arguing something pretty ridiculous here. We're saying that athletes should be brought up on charges for fighting because someone in the future at some point MIGHT be killed during a fight, brawl, tackle, race car wreck (which has happened), etc. its insanity. deal with it as it happens.
