Howard Stern and his agent are suing Sirius XM Radio Inc. for failing to pay stock awards they say are due for helping it exceed its subscriber growth targets and go from a distant second to the dominant satellite radio service in the country.

In a suit filed Tuesday in the Supreme Court of the State of New York, Stern's production company, One Twelve Inc., and his agent Don Buchwald said that Sirius, based in New York, made an initial bonus stock award after Stern started in January 2006 but failed to do so over the subsequent four years.

The suit claims that Stern's signing helped Sirius exceed its subscriber targets by at least 2 million subscribers in each year of the contract, triggering a new stock award each time. It also said Stern put Sirius in a position to complete its 2008 acquisition of XM Satellite Radio Inc., which had also courted Stern years earlier.



Yes, you're reading that right: Howie wants to be credited for every single subscriber that Sirius picked up in the merger.

That's kinda nuts even for him.

well, duh. my partner at work listens to stern all day and he (stern) is constantly talking about how all new subscribers are due to him. after he resigned was the best, totally nuts.

I heard him today talk about the AT&T and T-Mobile merger and how he said that it will probably be quickly approved. Unlike the Sirius and XM merger which was delayed for so long because he's the government's public enemy #1 and they just wanted to punish him personally.

I saw him on a TV talk show the other night. And he was so full of himself I think I turned it off. This also reminded me why I stay away from his radio show as well.

Well its completely wrong, but not the way he looks at it. He is taking credit for every XM subscriber they had at the time they merged with Sirius. Instead of looking at those subs as people that had XM and werent Sirius subscribers, hes looking at the merger as a mass Sirius subscription due to his being on it.

Its laughable. But then again this is the same asshole that went on Jimmy Kimmel just to announce hes done doing late night talk shows.

What would the last two days worth of publicity have cost Sirius/XM if they decided to buy it? Millions? This is starting to sound like a publicity stunt dreamed up by Howard and Mel.

Maybe it is. But the guy is claiming he brought 10 million subscribers to Sirius. If you take what they have now and minus the subscibers they had before Howard signed I think its impossible to come to that number without counting the XMers.

I suspect that Howard's lawyers believe that the language in his first contract is fuzzy enough that his claim will survive initial challenges, make it to a trial and force Sirius to settle out for roughly the same amount as his pay cut in his new contract.

It had nothing to do with the rapes, aggravated assaults on police / fireman, or the fact the overall drunken madness on Washington Street looked like Tripoli. It was all because he mentioned it on the air.
