On the one hand, the guy got drunk and killed somebody. Ruined a lot of other people's lives in the process.

On the other, he's facing 30 years in jail for it and if somebody makes a mistake, even a horrible one like this, do you get to go after everything they've got?

The judge says this is a "legal twilight zone".

He does, however, have a trust set up for his children which cannot be touched in the lawsuit. What he's trying to do is tap into his children's trust by giving his girlfriend a share. He's basically taking money from his children.

The contract written up for the girlfriend only entitles her to 5% of the trust. The kids get the other 95 percent.
