The tactic was the defense attorney's idea to give them closer to a victim status, even going back to when it was the poster child for hate crimes the prosecutor never believed it was a hate crime and only a drug crime. The only hate in the crime was for him holding back drugs.

Ironically no matter what way you slice it, its a good case to represent hate crime laws. Because either they did it because he was gay, so obviously fucked up there, or they legitmately thought it was preferable and gave them a better shot at leniency to say 'we flipped out because he was gay and came onto us.' So either the perps were bias, or the system was biased, and either one is pretty damning to me.
