Ok, my house is fairly sized, and it has one place in front to park and a drive-way that you can put at least 2 cars. Now my father only uses the driveway, because he doesn't want anyone hitting or scratching his car (the people around here are not the best of drivers, and neither are they courteous). Now, people like to just park in front of our house without asking or anything. And sometimes its extremely hard for my dad to get into the driveway itself.

We've called the town about this, and they've given us the "people can park wherever they want" bit, which I think its crap. Now, it's mostly the neighbors who have garages and driveways and too many cars to fit them all, and thats just bullshit, cuz they knew what they were gettin' when the moved in, and if they can't fill all their cars they can either sell the ones they don't need or fuck off.

Anyway, the deed to the house that we own states that we own 4 feet into the street. So would it be legal if we were to put up removable cement poles and a chain the block people from parking in front of our house within that 4 feet? Or maybe lines our something.

O, and if anyone has any other types of sugestions and stuff, that would help too, cuz we've dealt with this crap for about 2 years and we're extremely fed up.

These are the ramblings of someone who has never been to law school, so don't take my word for it. This is just the stuff that ran though my head:

Are you sure the town doesn't own 4 feet into your yard? That's how it usually works.

If you own 4 feet into the street, they claimed eminent domain and legally took it away from the property owner when the street was originally made. The town now has the legal right of way, and there's really not much you can do about it except call a lawyer and see if you can get the town to pay rent (in terms of lowering your Dad's taxes for land that the town actually has use of) or buy the patch of land outright from your dad. I'd go for the former because what happens if someone slips & falls or has a car accident on the patch of street out front of your house because a pothole forms and the town fails to fill it, do they sue the town or your Dad for failure to maintain the land? What about clearing snow? If your dad is the landowner, can the city bill him every time they send a plow down his section of the street?

But no, there's no way you can block the side of a public street. You're going to get fined if you do.

It has to depend how far the right-of-way for your street is. Chances are that there is no wa you can put up anything permanent in or that close to the street without ending up with a summons from the town.
i would say that the best thing to do is just put up a visible sign telling people tht unauthorized vehicles will be towed at their expense; then enforce it.
Either way, you have to realize that your neighbors will view you as the dicks of the block.
You could always just talk to them and tell then to stop doing it.

But the reason why we want to do this is so people can stop parking in front of the house and making it harder for us to park in our own driveway. Is there something we can do about that, or are we left with the possibilities of the rent and all the stuff you listed? Because we have the right to park in our own driveway too.

We don't care if they view us as dicks, because the ones that park in front we don't talk to anyway. And talking to them about it hasn't worked, because when we aren't home they park there anyway and if they forget to move it we're the ones who have to deal with the fact that THEY are being dicks when we come home and can't park in our own driveway.

ooh, I almost forgot.

I have the exact opposite problem. My "driveway" is really long. It's actually a city street, and my house is the only house next to it. My house is considered a "corner" property becaause of it and is set diagonally on my property, and I have to deal with all the silly "line of sight" rulings if I want to make any home improvements as a result even though there's nothing there but pavement. They had wanted to build houses in the woods behind my house decades ago but couldn't because the woods became protected land, I think part of the watershed.

So I get the right-of-way for the entire street (one lane, about 70 feet long) but for that I also have to plow it myself as the town treats it as just another driveway. I got a couple of potholes in the it and when spring comes, I have to pave it myself if I want it nice and pretty.


As for your driveway being blocked, every time it happens you have to call the cops & ask them to get down & ticket & tow whoever did it so you can get in & out of your own drive.

That won't foster neighborhood love, but screw `em. You're entitled to your own driveway.

If they are blocking the driveway, have them ticketed; often.
But i think, just having them towed will be a nice enough nuisance to them, to get them to stop. Jus put a sign there that says: ANY UNAUTHORIZED VEHICLES PARKED HERE CAN BE RETRIEVED AT: (tow truck company and number)

It dos't have to be a metal sign sunk into the ground with concrete, it cold just be a hand written sign, nailed to a tree. If you put it on a tree in the front yard it should be fine. Putting it up a few feet behind the curb in your front yard should be fine. If you really want to be sure, just put it up behin te line between the 2 front property markers.
i just bring up the sign idea so that people will know what will happen and then don't have to bother you when it does.

Despite what SerVice suggests, you can't have someone's legally parked car towed simply because it's in front of your house, whether you put a sign up or not.

Unless they're actually blocking your driveway, you're shit out of luck.

As stated previously, the roadway belongs to the township, city etc. As long as the vehicle in question is not blocking the access to the driveway, there's nothing you can do. Case closed!!

Move to a house were you can't see the street (really long driveway) Otherwise just don't worry about it unless you can't get into your driveway

I dont think you can do anything. You certainly dont own the street, no matter what the deed says. The town plows the street, they pave it, you only own the land up to the sidewalk, but the sidewalk and the strip of grass between the sidewalk and the street is the towns (even though YOU have to cut that grass and shovel the sidewalk of be fined(??) )
If you make a stink, the neighbors will retaliate because sooner or later, someone else will be parked in front of your house and youll have to park in front of somone elses house and then theyll come say something to YOU, and who needs it? If they are parking too close to the edge of the driveway, Id try keeping something on the grass by the curb like 4 feet from the edge of the driveway that sticks out over the curb into the street, like a pile of wood or pipes something that someone will not want to get so close to so youll have room to pull into the driveway. Something to act as a visual deterrant, but can be moved.

Paint a white rectangle in the street pointing out the location of your driveway. Since I got that in Bayonne, people are VERY wary about not crossing over the line.


*Or you could put a pile of F‘cesT in the street where they would normally exit their vehicle.

My family's house has a similar situation as yours. Essentially, there is nothing you can do. If you call the cops too many times, they will start to look at you as if you are the trouble maker. The other thing is that as residents of your street, they will most likely get out of any ticket they receive.

We used to have a "no car in the street after 2am" rule where your car had to be in your driveway unless you had good reason for it to be parked in the street.

i really hope you are pulling into your driveway and not parallel parking. because when i lived in bayonne every other house had a driveway that people refused to pull into and just parallel parked making it finding a parking spot virtually impossible. if you are just complaining because you can't pull into your driveway, just work at it you should be able to get in. and you WILL be looked at like the neighborhood asshole if you try and get someone's car towed when they are parked legally. honestly, no offense but if you tried to have my shit towed i'd punch you and your father in the neck.

Well the way people park around here my dad has to pull in backwards because it is a really narrow driveway and you just can't turn into it. We always use the driveway, and everyone around here knows it, but everyone makes it impossible for us to get into it. Now we are trying to get those lines on the ground so everyone at least gives us room to park in the driveway.

Get a can of yellow paint. Paint lines marking the space you need to be able to get into your driveway on either side of it. Write "DRIVEWAY" in between the two lines.

You get your driveway space and the rest is fair game.

I have to turn onto this big road from my side street, and there is this van that is always parked right at the edge of the street, in a legal spot, but making it very difficult to see if its safe to pull out because it blocks the view. Even in that situation, I dont think the guy can be ticketed, even though his presence is a obstruction. Unless sooner or later some kid gets killed or a deadly accident, then they might put up a sign saying "No parking here to corner" or something.

You could also write the local town supervisor to complain about the situation and request that an ordinance be put in place, that it's a dangerous obstruction. I've seen it done before. Plus if you put your complaint in writing it does seem to have some affect. My sister has done it with local traffic lights, as well as other folks in my family on other issues. Write a letter.

just put 2 in a space large enough for a car to fit to "save" your space. and if someone is making it difficult for you to get out of your driveway, that is nearly the same as blocking it and is grounds for calling the cops to have that car towed.
