"A Central Florida woman was fired from her job after eating "unclean" meat and violating a reported company policy that pork and pork products are not permissible on company premises, according to Local 6 News.
Lina Morales was hired as an administrative assistant at Rising Star -- a Central Florida telecommunications company with strong Muslim ties, Local 6 News reported.
However, 10 months after being hired by Rising Star, religious differences led to her termination.
Morales, who is Catholic, was warned about eating pizza with meat the Muslim faith considered "unclean," Local 6 News reported. She was then fired for eating a bacon, lettuce and tomato sandwich, according to the report."

That's a tricky situation. On the one hand, why the fuck should anyone care what SHE'S eating? Then again, if it IS a private business, they can set the rules. I guess the thinking would be that if someone is eating it, they get the meat on their hands, and then they're spreading the "uncleanliness" around the workplace. Of course, is this somehow violating her civil rights? Not even private companies can do that, and often have to make concessions for people who are the exception to the workplace norm. Than again, she was warned already.

That's just gay. But like Mojo said, if it's private, they can set their own rules. But they probably need to inform their employees a little better. But hey, if they want to fire someone over that and have to hire a new person and train them, etc. more power to them.

I don't remember how it resolved, but wasn't there an incident in the last year where the Catholic church or a Catholic organization was told they could not carry a health plan that did not cover abortions, even though it violates their religious precepts? Is this any different?

Well, for one, this has nothing to do with a health plan.
Don't get me wrong, I think it was incredibly stupid for this woman to be fired this way. I'm just saying, from a legal standpoint, I would think it would be a much different situation from the example you brought up.
I'm fuzzy about religious restrictions/freedoms in a private workplace. A friend of mine worked for the Chick-Fil-A years ago when she was in high school, and apparently they're run by Southern Baptists. She had to join in on a "group prayer" of sorts before the start of a shift, which sounds completely nuts to me, but apparently these people got away with it, or at least they did at the time.
What gives?

But the REALLY stupid part that comes up is that this could truly effect the company's performance. Like, since this is "unclean," if she's getting greasy bacon all over her fingers, and then goes and handles stuff that some of the other co-workers need for THEIR work, but apparently now they CAN'T touch it because it's "unclean" like the pork...believe it or not, this religious nuttiness is now going to be detrimental to the work performance on a larger scale. So she can keep eating pig, but it might end up getting her fired anyway because the largely islamic company goes out of business.
Man, that's SO stupid on SO many levels.

This is an area where I have absolutely no idea what the answer is.
However under Title VII of the 1964 Civil Rights Act:
Employers may not treat employees or applicants less - or more - favorably because of their religious beliefs or practices. For example, an employer may not refuse to hire individuals of a certain religion, may not impose stricter promotion requirements for persons of a certain religion, and may not impose more or different work requirements on an employee because of that employee's religious beliefs or practices.
If I understand correctly, the only ones potentially expempt from this are employer's that are "religious" in nature (a church).
I'm not a lawyer (but we have at least one on the board here), but as a lay person, if I were representing the employer, I would claim that the rule for not eating ham on company property is applied equally to all employees, thus it does not unduely discriminate - providing all employees are informed of this rule at the time of hire.
If I were representing the woman I would probably push the idea that employees cannot be forced to participate (or not participate) in religious activities as a condition of her employment. Not eating meat is in a sense "participating" in the observation of the company's religious policies.
What's really weird here is that I could very easily see a judge deciding that the company would have to offer to lunch areas. One for those observing the non ham eating habits of the Muslims employed, and another for those that do not observe the rule.
Am I completely off base with the above possibilities?

There are a lot of good reasons not to eat pork.
The species barrier between people and pigs may be easier for a virus to cross than previously thought. Also, a pig respiratory tract is receptive to both human and bird flu viruses, making the animal a potential breeding ground in which a mutant virus could evolve and possibly be transmitted to people

But in this matter, her whole case is that she was not given a written statement saying she cannot eat pork within their building. What I am curious about is why did she buy the sandwich, go back to work, go to the cafeteria and eat it there? If she had time to eat in the cafeteria, why not eat it when and where you bought it? Just wondering.
