I really think you either miss read it or took it the wrong way. I am not saying it is 100% but the best I have read about the whole thing.

I read it just fine. He made a few decent points, but then framed it with jingoistic tripe that doesn't apply at all.

Look, there's not much opinion to it. The First Ammendment has nothing to do with this. The troops have nothing to do with this. It's that kind of stup that serves to accomplish nothing...it trumps people up and makes them feel better about being outraged or complaining and they don't end up actually doing anything.

Yeah that is hilarious, it took steve carr to tell her to straighten up. Ha. I've noticed at least 2 or 3 other updates/retractions where they allowed comments. One was Neal Boooooortz, and couple others. At least its forcing them to rethink it a bit.

we're getting into a situation where certain rights that are supposed to be guaranteed by the constitution are somehow prohibited by society. this mentality doesn't even hold up in court and yet it's already changing our everyday lives (the only way imus will go to trial is when he sues cbs). in the last 5 weeks look how many shows have been forced off the air by the media and "special-interest" groups. they're not just getting these guys fired, they're telling us what we can and cannot listen to/watch/read....

i think we all see what has started but don't have any idea where it will end it it keeps up...

There's a subtle distinction here that people need to try to get. I think Mojo does now, but some of O&A's defenders dont, and it hurts your arguments. Its not about Free Speech or the 1st Ammendment in any legal sense, none of these cases will make it to the Supreme court. At least not on Free Speech grounds.

Its about people's personal TOLERANCE for the speech of others, and their personal HYPOCRISY when then start calling for people's jobs as they go about exercising their own 1st Ammendment rights.

The answer to speech you dont like is to respond with speech of your own. But when you start targeting sponsors and call for firing someone, then you're not trying to win a debate you're just out for some blood. If you think you're right, you should be able to win the debate in the public arena and not need to SILENCE those who you disagree with.
Its also self defeating since you raise the profile of your target and make them into martyrs, which benefits them in the long run.

I see it holding up in court completely. I don't see anything happening with this situation that would lead to a lawsuit where the court would say the media, the special interest groups or anyone else did something that violated any laws or duties.

I had a couple other thoughts about this issue that I think would be helpful.

Some people have said that corrections that the First Amendment is not being violated are semantics and nitpicking. This is not semantics because if you can't identify the problem/issue correctly, the resolution/answer cannot be framed properly.

If we had a First Amendment/Constituional violation, the person whose rights were violated would have legal relief against the violater. That's not the case here. No one has violated any law, or the Constitution.

What we have here is private groups creating/displaying "outrage" against other radio hosts and using commercial leverage against those hosts' employers and/or sponsors (i.e. remove those hosts from the airwaves or we will not buy your companies' services). You're never going to outlaw that, nor should you. So the answer has to be to display public support for the hosts and let the sponsors/employers know that firing the hosts, etc. will cost them more money than if they keep the hosts (i.e., I won't listen to your station or buy your products if you have the host removed).

Another way is to convince people of the social ramifications of these types of incidents, i.e. if entertainers, public speakers are in economic fear, they won't be as free to entertain the public. Their creative output will be stifled and society will suffer for it. In other words, the long term effects of these types of incidents will be more harmful to society than having some people being offended in the short term. Argue that what's going on is akin to people burning books because they are offended by the material in the books. The other side may not think it's a completely accurate analogy, but that's what debate is.

CBS absolutely did violate their duty to honor Imus' contract. I'll bet anything that Imus wins if the case goes to court. Obviously we don't know what the true language is in his contract, but the thing he said is the same as what he's said for decades. The company knew this, and kept him employed knowing the same type of things would continue to be said. He didn't step over any line or violate any FCC regulation. In my uninformed opinion I don't see CBS having a leg to stand on. I'm sure a settlement will be reached just to avoid unnecessary mounting legal costs on both sides, but Imus will get his money.

OK, all you guys, I know you have lots of knowledge and experience. I mean this in a completely positive way - no disrespect - can you guys that do have all this expertise please channel that great energy into helping us in our campaign to stop this bogus censorship? We need guys like you with the expertise to help us in our letter-writing, protesting and email campaigns! Let's transfer the focus from internal arguments about the letter of the law - into action! A lot of us are busting our tails to make people take note.

Whatever the semantics and legal issues are, we must take action to prevent the world from becoming boring, sucky, and PC!!!

Letter writing campaigns, e-mails and small gatherings/protests don't get much done. The main issue here is money...somebody needs to set up a fund that can be used for buyings ad space on TV, radio, newspapers, magazines, billboards, etc.. Efforts should be made on a massive scale to make contact and get the public support and endorsement of any kind of big-ish celebrity that can be linked to the shows or a politician with even a little bit of name recognition or authority on a "national" scale making comments in support of not firing these shows. Any boycotts need to be on a big scale. A petition would come in handy finally if you, say, got 1,000 names and addresses of people from a particular area and then sent that to sponsors on that station (ideally the ones that aren't massive corporations that can shrug those numbers off) with the statement that so far this is how many people will never purchase their products again if they pull their ads from these shows. And, yes, contacting the ACLU is not a bad idea.

What's the problem? This all takes time, money and organization, and a lot of each.
