I don't think they are necessarily safe on xm. There are advertisers and they are in the middle of merger talks, they probably don't need o and a on the front page for something like this.

Considering how slow a news day this is so far, I can understand Ant's paranoia. In past I'd say this is nothing, but there is a merger taking place, some "offensive" comments were said about a black woman, it all adds up to an unfortunate recipe for them either being fired or suspended. 1-The homeless guy did most, if not all of the attacking. Anthony threw out scenarios and rephrased what he was saying, but I think he carefully walked the line.
2-They attacked public people (Condi Rice/Laura Bush/The Queen), who are considered to be fair game
3-It was said on XM.
All of that being said, in todays environment who the fuck knows what the rules are.

Dont forget, even the JV and Elvis shit was pretty similar to the Imus thing in 2 important regards. They involved "Regular people" or civilians in both cases, not public people. And they both involved racial stereotyping. Neither of those applies here to O&A.

The segment is not only vulgar, but pretty violent (warning: extremely vulgar language). As XM and Sirius attempt to woo Capitol Hill for a smooth merger, it seems like only a miracle will save these hosts that were fired before for going over the line.

Mancow is the biggest doche bag cocksucker in the world. Just needed to get that out of the way. It is one thing to not like someone, but you have to say when something is a joke and when it isnt. If you listen to the line it is clearly a joke and they were just making up a scenario that they always do. A. I don't know that ads are a huge part of their revenue. XM relies on subs as their primary income.
B. The XM subs aren't exactly Coca Cola and McDonald's. I just don't see people boycotting the "write it on a rock" guy or the "Tell them about the discount, Harry". If they do, there are other advertisers of that caliber that will likely jump in.

1) What "group" is upset about this? Sharpton and Jackson will NEVER support Condi cause she's a republican. Without a group leading the charge there isn't anyone to carry the story.
2) Anthony never says anything that could be defined as his own thoughts in the clip. If anything he's just restating something homeless charlie said. Could be key if this did blow up.
3) XM has the set ups in place to Block 202 and other XL channels.
Just some thoughts. I'm not sure if CBS would use this as a means to can them, CBS has proven to be massive D sippers that wet the bed at the slightest thing makes a headline. Still I don't think this story has legs enough to cause that to happen.

As of right now I don't see this being the same situation as Imus. it was XM and said by a homeless guy who is obviously unstable. CBS made it clear that it didn't happen on their watch. I think that would mean they won't acknowledge it. I guess unless sponsers pull from them too

Wow, I saw it completely different. Colmes was offended as a liberal that Mancow was calling O and A liberals. His debate with him was petty. No need for him to go after Mancow, he very clearly didn't have much of a point. Hannity made a strong freedom of speech argument. H & C viewers aren't interested in radio wars, they only care about Hannity telling them what to think. I don't care for the guy, but he was dead on with this one (obviously). His point was if they go after O & A now, then they'll come after him next, which his viewers certainly wouldn't like. That's a lot stronger argument than " O & A party rock".

I think people are mistaken when they say that this(and the Imus thing) is a free speech issue. Opie and Anthony(and Imus) are allowed to say whatever they want. It doesn't mean that they are going to be paid for it. It would only be a free speech issue if they were arrested for it.
Personally I think everyone has overreacted to this(Imus shouldnt have been fired as soon as the Rutgers team accepted his apology). Opie and Anthony's case is a little different though because the comments were said on XM which is a pay service and I dont think anyone can pressure them off the air. If XM chooses to get rid of them(I hope they don't) it will only be because of XM management(not advertisers).

Things won't change for Ron and Fez...it's 2 entirely different shows. The 'shock' content of the buddays is far less than that of O and A (side Dave drinking piss, fucking Jelly and wanting to stab his eye out). Ron and Fez have an ability to put on virtually the same show whether they are restricted or not...I don't care who you are, the O and A XM and Free FM shows are very different.
And if they (FCC) do anything they will Deal with me now!

There's also a very good argument that they don't have jurisdiction anyway. The traditional reason the government (i.e the FCC) can regulate broadcast radio and television constitutionally is because of the limited number of the broadcast spectrum. They don't have that with satellite radio.
I'm not saying that the FCC wouldn't try, but they would have a fight that they could easily not win.

I am glad that some of these articles coming out are putting this in at some point..
Because the show airs on satellite radio, there are no federal restrictions on its content. According to XM's Web site, the radio service has parental controls that allow users to block access to channels that frequently contain explicit language. Those channels are designated with an "XL" notation.

I was thinking the same thing. I did not hear the show today, but I was suprised when I read on here that they apologized, which was more reason that I thought this was a bit, since they seem to be doing everything they said they would not do. maybe they were told go out and say sorry, and there is no way you are going to get fired because neither company will bow to the pressure.

I'm hoping it's cooling down finally. I think there were enough voices saying leave it alone. I’ve since decided to retract and ignore anything and everything that has to do with Opie and Anthony. In the span of 4 hours from the time I posted my comments on their behavior and a stunt related to a radio broadcast, I received 43 comments in my moderation que.
The vast majority of those comments went lightyears beyond printable per my Comments Policy so I have to say one thing…
I’ll admit that the original post was based entirely on an emotional reaction to the opinions of a pair of shock jocks, but irrational, vitirolic, hate-filled comments defending someone that would probably kick you while you were down regardless of your devotion to their show is simply stupid.
Do I think they have First Amendment protection to say what they said? YES… but.
The First Amendment clearly states that Congress (read: government) cannot make what you say/express illegal, nor can they enforce any negative punishment upon you for those opinions.
The First Amendment does not give you employment protection for your mouth. If XM decided tomorrow to can Opie and Anthony for anything, so long as their signed legal agreement between both parties does not forbid such, they’re free to do it… first amendment and all.
Way too many people in this country seem to think the First Amendment is an asshole license. It’s not.

Why would you direct them to make a public apology for comments a crazy homeless man made on a pay network that you promote as an alternative to mainsteam regulated media? Sponsors bought time on a show with a very clear and defined past, so why change your tune for a few dumb comments?

In a way, the fact that satellite radio exists makes it HARDER to argue for more expression on the terrestrial airwaves. The idea is just like with broadcast TV and Cable, if you want the more edgy content, go to satellite. People are paying for that, if they dont like it they can cancel their subs. Over the air TV/Radio is available free to everyone, so they want to keep that content safe for the kiddie poos.
Eventually though, when most content gets delivered to most people by some handheld device (like the newer Treo phones) the line will get blurred again, and maybe then this will no longer be an issue. But thats years away.

To be fair, what we think free speech is has developed in 20th century. The arguments were most certainly strong when the constitution was formed. You can't really argue with the forceful wording of the First Amendment. As for the interpretation of it, it wasn't touched till the 20th century and there has been an undisputable strengthening of what the 1st amendment means. There hasn't been a significant challenge since 69. What the exactly the government can regulate has a large effect on what the general public accepts. That's why I'm not sure why people aren't arguing that these ideas have been debated and there are significant reasons for them to abided by in more aspects than just government regulations.

That's very true and i agree. The idea of free speech and first amendment are so synonymous they do get used interchangeably. I'm actually glad that the precedent the court has set has such a strong presence, but yeah you just can't scream first amendment and expect help. Now if this leads to more FCC regulations...

Airing a homeless man fantasizing about raping Secretary of State Condoleezza Rice is just the latest in a string of radio incidents that prove America is ignoring the principles upon which it was founded.
As deplorable as such jokes may be, the laws of the government for which Rice works protect the rights of radio personalities Opie and Anthony.
An affection for offensive humor is not shared by many Americans. But these two so-called “shock jocks,” whose time is mostly spent delivering witty riffs on the news, making fun of people who deserve a good smashing and talking like a bunch of guys sitting at a bar, should be able to say what they want.
First and foremost, “Opie and Anthony,” a daily morning show aired on WFNY and subscription-based satellite service XM, is a comedy show. It’s raunchy, it’s edgy, and it’s the listeners' prerogative to listen to what they want.
Unfortunately for radio personalities such as O&A, it’s the shocking things they do that makes headlines and dictates how the mainstream public views them.
Previously, radio icon Don Imus was fired for calling the Rutgers Women’s basketball team “nappy-headed hos.” Soon after, midday New York talkers JV and Elvis were suspended indefinitely for airing a prank call to a Chinese restaurant.
Imus, an old white man who wears a cowboy hat, hardly learned the term “nappy-headed hos” on his own. JV and Elvis didn’t invent the Chinese restaurant prank phone call. But for some reason, each has recently been severely punished for doing or saying what’s been done or said before.
Opie and Anthony are far from the first people to air over-the-top comments about government officials.
Moreover, the comment that’s causing this stir is only part of the story. Taken out of context, the headline “Opie and Anthony Joke About Raping Condoleezza Rice” looks bad. Really bad. But nobody’s reporting the complete context in which it was said.
The homeless man, named Charlie, was on a profanity-laced rant where he attacked Al Sharpton, Jewish people, white people, and other important females such as First Lady Laura Bush and Queen Elizabeth II.
He was an equal-opportunity offender, ripping on everyone.
But one Web site that no one has heard of, breitbart.tv, decided that comment was wrong and sent only one minute of audio to the Drudge Report. That was the seed that started this whole thing.
To start both their shows Friday, Opie and Anthony apologized for airing the hurtful words about the Secretary of State. They know their creative freedom comes with a higher level of responsibility and they are sorry. But is that going to be enough? Imus apologized. JV and Elvis apologized. Both are now gone.
Though no official action has been taken on Opie and Anthony over the statement (which, incidentally, only aired on XM, a world free from regulation by the Federal Communications Commission and where listeners pay for the privilege to hear O&A), the half-informed public outrage is enough to give pause.

What did they get right? The guy tosses out the First Ammendment as if it has anything to do with the events he just spelled out. And the military has zero to do with any of this. Those were all just random slogans tossed out that ultimately mean nothing in all of this.
I really think you either miss read it or took it the wrong way. I am not saying it is 100% but the best I have read about the whole thing.
