Damn, I wish we could do this in NYC. If someone opened a can of benzene in an apartment we'd have hazmat there in five minutes, but we allow smokers to pollute with poisonous chemicals all day long. Time to get our priorities straight.

I'm pretty sure you're not allowed to smoke in my apartment building. I could be wrong, but I don't understand why people are always smoking out front if they could just do it in their apartment.

I have plenty of friends who smoke who go outside even at home. If you smoke constantly in your apartment every inch of it reeks, the walls turn yellow and non-smokers will avoid the place like the plague.

Wednesday in Calabasas, the City Council plans to vote on expanding its anti-smoking law to bar renters from lighting up inside existing apartments. It would exempt current resident smokers until they moved but would require all new buildings with at least 15 units, including condos, to be smoke-free.

Whenever you have laws putting restrictions on real estate, you're going to see "grandfather clauses" like this one because otherwise there are constitutional issues with banning things that are already existing or activity occurring at the time the reg takes place.
For instance, pools were banned in my brother-in-law's neighborhood at one point before he moved in, but his house has a pool because it existed before the zoning reg. and was grandfathered in. They couldn't force the previous owner to remove his pool, etc. without having to pay for removal and loss in real estate value.

i have been saying that for years, especially in Manhattan when they are loud at 2am standing outside of peoples apartments.
I think if you live in Manhattan you shouldn't be allowed to complain about certain things being too loud.

nah, it's the groups of 20-30 people out on the streets under apartments (like bar 9, for instance) like nick said. you break it up and less people will go out as well.

When I go out DC I have to smoke on the street, people complain more about having to walk through the cloud of smoke than the noise of smokers gathered on the street. Of course, trucks, buses and cars spew more than we could but that's another story.
You forced us outside. Now suck it up.

I do not go to DC bars much anymore because i basically pay the entrance fee, then spend the rest of the night mostly outside bullshitting with friends. I smoke, but never in my house. I can dig apartments not allowing smoking inside.... other people will have that unit, but condos? if i bloody own a place, i'm going to do what i please within it's walls.

FUCK YOU....... Smoking isn't illegal right now, and alot of people have been doing it way longer then you have been dealing with it outside of bars. In fact, if it wasn't for non smokers making all these big deals and forcing laws to be passes, none of that would happen. People wanna smoke, let them fuckin smoke. You don't like it, there is miles of sidewalk you can stand on where no one is smoking.
I get the bars thing and inside certain places, cause that bothers people. But FUCK YOU when you try to get the balls to tell people they can't even smoke outside.

I smoke and I do not smoke in my apartment. I don't like to be surrounded by smoke all the time. So I go outside and while all the trucks go by shoot out their shit I add my own. I am not one of those pollution nuts, but I don't want to hear how Smoking outside and your polluting the air.Please!!!
Now if the city told me that I could not smoke in my house that would be bull shit. This is my place, I may not own it but I pay to live it in, so it is mine... So if the great fuckin city of New York wants to pull the Californian shit, let them try. Then again with Michael the fag bloomburg as our great Mayor...he just might. Anyway for this city to make a buck he will do it.
So I can't smoke in my house, then what other dangers will be illegal. Can't eat fatting foods in my house, can't drink 12 beers and half a bottle of vodka, and can’t jerk off too close to the outlet...woo that might be bad and they will give me a ticket. If these dopes in California want the government in their houses then I hope the big earthquake finally hits and we can be done with them.

Hello again..I can see not smoking in restaurants; I don't want to pay for food and have to taste someone else’s smoke. That I can understand. But a BAR..I am going to a bar to get drunk and hopefully laid. 2 things that could kill me. So I can sit and drink and kill my liver, and talk to some slob, who might give me VD, The HERP, & HIV.
I know the ban was for people who work in bars. But you know what DONT WORK IN BARS. Hell I hate to work with electricity, I am scared shit of it. And electricity will kill you faster then smoke, so should things change, should we not use electricity. No. That is why I don't work with electricity.

Smoking is like no other activity. You are not only hurting yourself, but everyone else around you. Inside or out you are polluting the air and there is no benefit to anyone. In an apartment you are poisoning yourself and your neighbors. If you want to drink yourself to death in the comfort of you own home fine. But subjecting neighbors to a health hazard because you choose to endanger yourself is not right.

The fact that the state and Feds generate tax money off of tobacco is why these hypocrites will never ban it. If they really thought smoking was this horrible evil they'd just outlaw it, but they like the money in generates and its an easy election issue to get "tough on smoking".
If people want to smoke in their own home let them. If people who own apartment complexes don't want smokers then thats fine too, But we don't need a fucking law to regulate it.

i can't imagine someone ever getting cancer because their neighbor smoked. i've also never noticed is any neighbor was smoking. i don't think that's realistic, although i know now someone will say they can always tell when their neighbors smoke.

you can. If you live in an apartment building you can usually smell the stench of smoke. If you go in their apartment it will smell and if not you sure will see yellow all in the ceiling and corners of walls.

i'm saying i've always lived in apartments and never noticed a neighbor's smoke (and i know they smoked). on rare occasions i'd smell pot for a 2nd or two, but that's about it. i also imagine the pot was because kids were hiding it from their parents and smoking it out a window. as for the cigarettes, doesn't matter to me if it smells in their place, it's never made itself known in mine.

I used to have an apartment in Astoria, Queens and the chick downstairs was a chain smoker. Anytime people would come into my apartment they'd ask "you smoke"?

Thats a great argument except you have to factor in the cost of all uninsured people (students, low income workers, bums, etc...) who smoke that get all kinds of diseases (cancer, heart disease, asthma, etc) and then the whole of society goes into paying their hospital bills oh yeah and all of the wronful death suits against the tobacco companies that have to get subsidized by the taxpayers. Maybe instead of buying cigarettes you can go to the hospitals and courthouses and just stuff cash into the pockets of the lawyers and doctors cause thats the only people who are the recipients of the BILLIONS OF DOLLARS A YEAR you are generating.

That's a specious argument. Junk food in and of itself is not inherently bad. It can be enjoyed in moderation with no ill effects. Cigarette smoking on the other hand is deadly from butt one. Even moderate use causes ill effects... just quit and you too will become a vehement anti-smoker

I just wanted to state the point..No one should be told what to do in their own home. My sister in-law and a family friend live in these nice communities and they can't even put a fence around their property. They pay a boat load of money for the home, yet if you want to put a fence up you have to get approval. This is my home. I will do what the fuck I please.
Condos and Co-ops especially in Brooklyn are costing a fortune, if I pay for one, there is no way..No way is anyone going to tell me what I can do in my home.
