A deadlocked jury failed to reach a verdict Monday in the case of a girl accused of assaulting a police officer after officers allegedly mistook her for a prostitute.

After eight hours of deliberation, a jury of three men and three women told Judge Roy Quintanilla they were hopelessly deadlocked in the case charging Dymond L. Milburn, now 15, in the Aug. 22, 2006, assault of Galveston police officer David Roark.

So a 12-year girl is mistook for a prostitute. That's not good.

Milburn was 12 years old when the officers about 7:30 p.m. exited an unmarked van and approached her in her Galveston yard.

Narcotics officers were called to 24th Street and Avenue P1/2 to investigate a complaint of three white prostitutes soliciting in the area and two men dealing drugs.

Griffin in Monday morning’s closing arguments repeatedly told jurors police shouldn’t have mistaken his client, who is black, for three white women.

“They clearly had probable cause to search for three white prostitutes,” Griffin said.

Are you fucking kidding me? These cops went after a 12-year black girl, when searching for 3 white prostitutes? Is Texas out of their fucking mind?

Milburn ran, possibly 2 feet, from the breaker box to a bush, where she hid while officers tried to pry her away in handcuffs.

Police should have admitted they were wrong to detain Milburn, Griffin said, but prosecutors said it was the officers’ duty to investigate the complaint.

Prosecutors said Milburn hit an officer’s face, but Griffin questioned whether the assault occurred, because both of Milburn’s hands were grasping the base of the bush.

This is why they arrested and charged a 12-year old girl with assault? That's FUCKING INSANE! This whole case is maddening...and the only silver lining is:

Griffin filed a federal lawsuit last year against three officers, Roark, Sean Stewart and Sgt. Gilbert Gomez, accusing them of violating Milburn’s constitutional rights.

That case could go to trial late this year or next year.

The mere fact that this case didn't become a national sensation is beyond me. I know its convenient to spend time on white, blonde teenagers....but maybe the Nancy Graces of the world should use a bit of their airtime on the Dymond Milburn's of the world too.

that's what I was going to say... I guess we should start teaching police etiquette with the kids rather than sex education, well or at least before we start sex ed, cause clearly they are more likely to get wrongfully arrested before they have sex.

A 12 year old girl in her own yard? If she is hiding in a bush it seems that she might be scared. They could try to talk to her before cuffing her. Also the cop that was assaulted must carry a purse to claim he was assaulted by a little girl.

Galveston cops have a serious problem and have had prehurricane. There are several who are under investigation for tactics such as this. In my opinion I am disgusted that this happened to this girl and some of the other things going on.

I live in between Houston and Galveston but I am more scared of certain parts of Galveston than I am in some parts of Houston.

when my GF was in high school(expensive private) the students were warned 1hr prior to police using dogs on the lockers, the dogs WERE NOT allowed in the classroom, so the students moved all the contraband into their bookbags and pockets!!!!

BTW EPO, most people who are raised with 1oz of respect for police or elders, would have complied with the cops, NOT TRIED TO RUN AWAY!!!!!

I have to address this. That is NOT the case. Obviously where and how you are raised has alot to do with how you react.

This was a 12 year old black girl in a place that seems to commonly have hookers and drug dealers. You really think this girl has been raised to respect cops? Most likely she was raised with EVERYONE around her hating them. Black people in general tend to live with a natural fear of police, and in some places, I cant say I blame them. Should the kid have run, probably not.

But if you are lookin for 3 white hookers, you probably wouldnt go into the yard and arrest a black girl. And also, she didnt run from the cops. She hid behind a bush on her yard cause she was scared. She didnt just take off running. Like I said, she was probably raised to fear police.

People need to start to understand that the rest of the world doesnt necessarily see things or think the same way as you or your area may think.

Even middle/upper class white got everything going for them type mostly only "respect" cops because of fear of their power to rain down on you if they feel like it or in a bad mood vs a good mood. Sure there is respect for good jobs they do, but lets be honest none of us want to take the chance to piss one off and have them make up some reason to ruin your day. 80% fear / 20% actual respect - IMHO.

Now that I'm home I'm able to access some more alleged information (http://boingboing.hexten.net/2008/12/18/plainclothes-police.html) about this case with the background:

As Dymond headed toward the breaker, a blue van drove up and three men jumped out rushing toward her. One of them grabbed her saying, “You’re a prostitute. You’re coming with me.”

Dymond grabbed onto a tree and started screaming, “Daddy, Daddy, Daddy.” One of the men covered her mouth. Two of the men beat her about the face and throat.

As it turned out, the three men were plain-clothed Galveston police officers who had been called to the area regarding three white prostitutes soliciting a white man and a black drug dealer.

After the incident, Dymond was hospitalized and suffered black eyes as well as throat and ear drum injuries.

That's right....the cops not only accused a 12-year old of prostitution even though she obviously didn't fit the profile of their search...they beat the fuck out of her. And then they...

Three weeks later, according to the lawsuit, police went to Dymond’s school, where she was an honor student, and arrested her for assaulting a public servant. Griffin says the allegations stem from when Dymond fought back against the three men who were trying to take her from her home. The case went to trial, but the judge declared it a mistrial on the first day, says Griffin.

And she was an honor student...who got beat up for beating in her front yard at the age of 12 and then was arrested for it.

I challenge you to tell me that this kid wasn't damaged by these irresponsible officers.

I'm sorry, I said "alleged" and their story quoted the reputable newspaper Houston Press and the Courthouse News Service. And here's the irony....that blog sugar-coated the nature of the police's actions.
