It is statutory. As Ron pointed out, we are not talking about a girl a week away from the age of consent, but closer to half a decade away.
Statutory rape is rape that was consensual, but the person lacked the "legal" capacity to give consent.

Obviously if a 21 year old has sex with a 16 year old the night before her 17th birthday, that is a different crime than if a guy holds a knife to a woman's throat and forcible rapes her.
But, yes, 12 is another story. All states are different. In NY, I think it is statutory is he is over 21 and she is under 17.

That is why it is statutory rape and not rape. Different crimes. The law deems that even if a 16yo says "yes"- gives consent- that consent is not recognized.

It is a different crime than forcible rape.
In NY, I think I am right- It is illegal for anyone to have sex with anyone under 14, and it is illegal for anyone over 21 to have sex with someone under 17.

So, a 13yo is committing a crime by having sex with another 13yo. And a 22yo is committing a crime by having sex with a 16yo. But, a 20yo can have sex with a 15yo.
