If studios make money on shitty movies, they have limited incentive to make good movies. Soon enough we'll have only a dozen indie pics and maybe 4-5 OK studio films a year, and that will be the end of cinema as an art form. It will turn into mindless entertainment to appease the repressed masses and then the Visigoths (like goths, only less makeup) will sack New York and LA, and then we annihilate ourselves and then 10,000 years later, monkeys are running the place and a guy finds the statue of liberty buried in the sand. or something like that.

The Supreme Court has just ruled in favor of white and Hispanic firefighters who were denied promotions when the City of New Haven threw out the exam they scored highest on, citing the fact that no black firefighter scored high enough. In Ricci v. DeStefano, the Court reversed a decision by the Second Circuit Court of Appeals, including Judge Sonia Sotomayor, who Obama has nominated to the Supreme Court.

The appeals court, in an unpublished ruling designed to avoid scrutiny, had held that the City could throw out the test simply because the test excluded more blacks than whites, meaning it gave rise to a “prima facie” case of unintentional “disparate impact” discrimination (disparate-impact is when a test excludes substantially more members of one race or gender than another). The Supreme Court decided that this was not reason enough to use race, at least where the test measures useful job skills.

In the Ricci case decided today, the Supreme Court took a middle path, saying that a mere racial imbalance (or “prima facie” case of disparate impact) is not enough to use race, but that disparate impact can be enough reason if there is “strong evidence” that the test not only excludes more blacks than whites, but also is not “job related” in the sense of requiring knowledge irrelevant to the job. Since the City of New Haven had no strong evidence that the test was not job-related, its decision to throw out the test was illegal.

No they supreme court is the highest they have, so its not like its going get over turned again, they had a test in place and the blacks failed the test, but white and hispanics did well. Why do they feel they need to throw out test results just because of race?

Some people dont test well, there is usually a reason for that, who ever tests the best should be given they jobs. Testing well usually is a stress test so that means you have people that perform well under stress in a high stress job, seems to me you would want them to test well for a high stress job like a firefighter.

And its not a race that tests poorly, its stupid people that test poorly.

Some people dont test well, there is usually a reason for that, who ever tests the best should be given they jobs. Testing well usually is a stress test so that means you have people that perform well under stress in a high stress job, seems to me you would want them to test well for a high stress job like a firefighter.

And its not a race that tests poorly, its stupid people that test poorly.

it did not say that the blacks didn't do well under stress; it said that the differential in racial results doesn't make a prima facie case - you need to look further to see if there are job related issues. Had New Haven done more research into it, they may have been able to strike down the test.

there are examples of tests that give some people an advantage over others; this time they did not prove the advantage.

The question is not whether that conduct was discriminatory but whether the City had a lawful justification for its race-based action.
